HomeMy WebLinkAboutMINUTES - 05021989 - S.3 TOr BOARD Or SUPERVISORS Contra S.'3 FROMt Supervisor Tom Powers Costa DATE: County May 2, 1989 SUBJECTt Request Contra Costa Transportation Commission to Consider Allocation of Return to SoUrce Dol lar5-to local liwisdirtinnc for SR Ian Mai-ch R4r%QrOM SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION:' That the Contra Costa County Board of Supervisors request the Contra Costa Transportation Commission (CCTC) to consider, by December 1, 1989, the issue of allocating return to source dollars to local jurisdictions applying for SB 140 funds for construction projects beginning on or after January 1, 1990 and eligible for SB 140 matching funds. That the Contra Costa County Board of Supervisors suggest that the CCTC consider certain criteria in developing this plan: 1) Require that any local jurisdiction in making an application for SB 140 matching funds from the CCTC, amend their Resolution of Intent To Comply With the Growth Management Program, by July 1990, to indicate its progress in reaching compliance with the requirements of the Growth Management Program. 2) In the event that a' local jurisdiction votes not to adopt and implement, or through inaction not implement, the Growth Management Program, the advanced funds for SB 140 shall be returned to the CCTC with interest. 3) Each local jurisdiction shall agree to adopt a developer fee traffic mitigation program to further leverage the return to source dollars, used to match SB 140 and/or agree to participate in a county-wide developer fee traffic mitigation program to accomplish this goal . The CCTC shall determine the amount of the developer fee ratio after making a determination regarding the amount of return to source dollars needed to capture SB 140 funds. By December 30, 1989, each local jurisdiction must notify the state regarding its intention to proceed with matching money for SB 140 projects. Under the SB 140 program, all contracts must be awarded by June 30, 1991 and all money must be spent by June 30, 1993. Most local jurisdictions do not have enough money in their general funds to provide a match for the SB 140 program. Without being able to use return to source dollars for this program, nineteen jurisdictions in Contra Costa could lose a considerable amount of potential state money for needed projects. The use of Measure C return to source dollars for the SB 140 program provides an opportunity for jurisdictions to capture more state money for transportation projects in Contra Costa. SB 140 dollars can provide up to a 50% match, cannot be used for maintenance and repair, and are limited to construction. Gas tax revenues, other federal road improvements funds, other state transportation program funds cannot be used to match SB 140.
