BACKGROUND: The Richmond City Council recently asked the Board of Supervisors to take steps to increase' the bail schedule for specified drug offenses. The County Administrator' s Office forwarded this request to the Municipal and Superior Courts. The Courts had had in process for sometime a major review of all bail schedules. This review has now been completed and the attached bail schedule represents the consensus of the judges of both the Municipal and Superior Courts. The new schedule has been forwarded to all law enforcement agencies in the County and became effective April 1, 1989 . The Municipal Court Administrator notes in his cover memo that a number of bails have been increased substantially. The County Administrator will forward a copy of this revised bail schedule to the City of Richmond in response to their request that drug offense bails be increased'. It should be noted that in a number of cases the actual payment will be more than twice the bail which is shown on the attached schedule because of the addition of penalty assessments. The priors bail enhancement provisions on traffic offenses has been increased from the previous level of $5 for each prior offense in the past 24 months to $10 for each prior offense in the past 36 months . 3 . Where a fine is imposed or bail is forfeited on an offense occuring on or after 9-27-87 and before 3-1-88 . . . . $9 for each $10 of fine, or fraction thereof . C . where a fine is imposed or bail is forfeited on an offense occuring on or after 3-1-88 and before 9-1-88 . . . . $11 for .each $10 of fine, or fraction 1 thereof . I Where a fine is imposed or bail is forfeited on an offense occuring on or after 9-1-88 . . . . . $12 . 50 for j each $10 of fine, or fraction thereof . e. Where a fine is imposed or bail is forfeitef on an offense occuring on or after 1-1-89 . . . . $13 . 50 for each $10 of fine, or fraction thereof . 2 . where multiple offenses . . .The penalty assessment shall be based on the total bail of fine for all offenses . When is fine is suspended, in whole or in part, the penalty assessment shall be reduced in proportion to the suspension. Parking and registration or offenses by bicyclists and pedestrians are exempt from the penalty assessment. Automated County Warrant System Assessment: An assessment of $71 is to be imposed upon every person convicted under Section 40508 of the Vehicle Code, whether or not a fine is imposed ( Section 40508 . 5 VC) Traumjatic Brain Injury Fund Assessment: An assessment of $2 will be levied for the first violation of section 273151CVC and $5 for each subsequent violation of the safety beat provision. Page 1 I I PENALTY ;,SSESSMENTS - continued i I California Fire and Arson Training Assessment : There shall Be levied an assessment in the amount of ten cents ( $0 . 10 ) for every one dollar ( $1 ) , or fraction thereof , upon every fine, penalty, or forfeiture imposed and collected by the courts for public offenses , limited to violations of any section of the Health and Safety Code enforced by the State FireMarshal and other regulations and building standards enforced by the State Fire Marshall, the State Fire Marsh'al ' s salaried deputies or local agencies authorized to enforce those provisions pursuant to Sections 13145 and 131461 of the Health and Safety Code, or of any local fire code or ordinance . "PC"I designates "proof of correction" or "compliance" . If proof is not presented, the indicated bail and court appearance is required. When the citation indicates that it is issued in accordance with Vehicle Code section 406110b and proof of correction is submitted within the time limitation specified in the citation or any continuance granted, the violation shall be dismissed as provided for in Vehicle Code section 40522 . When the offense charged is 16028a VC, and proof that defendant was in compliance with insurance requirements on the date of offense is timely submitted, then the violation shall be dismissed as provided for in Section 16028 (d) CVC. i BaillEnhancement: The indicated bail is for a first offense . If the has a prior conviction, within a. 36 month period, the fail should be increased $10 for each prior offense . Failure to Appear Bail Increase: Upon issuance of arrest warrant or DMV Hold for failure to appear, bail shall be increased by $50 plus penalty assessment on any type case in the Automated Minor offense Record System (same as 40508a,b VC) . 1 Mandatory Appearances at Warrant/Hold Stage : In those cases in the Automated Minor Offense Record System (AMORS) a mandatory appearance in Court will be required following the issuance of an arrest warrant or DMV Hold for failure to appear if a mandatory appearance is specified for the offense at the current stage . Bail Amount of Parking Citation: At the time a delinquency notice is issued on a parking citation, the amount of the baillon the parking offense is the amount of bail specified in any attached schedules plus $10 . At the time a warrant of arrest is issued or a Hold is placed on DMV registration renewal the amount of the bail' on the parking offense is the amount of bail specified in any attached schedule plus $25 .
