BACKGROUND: Attached is a copy of Progress Report #5, for the month of December 1988, setting forth some of the concerns which have surfaced regarding time delays in the construction and other relatively minor problems which are being negotiated with various contractors. All work still appears to be within budget and very nearly on schedule. S DECEMBER 1988 EXECUTIVE SUMMARY A. INTRODUCTION: This report is subdivided into three major sections: 1) Executive Summary, 2) Detailed Schedule and Financial Information and 3) Attachments. It describes the design and construction progress as well as Areas of Concern for the West County Justice Center, Marsh Creek Detention Facility and Martinez Detention Facility achieved during the period of December 1988 as well as areas of concern. B. GENERAL: 1. West County Justice Center a. Community Participation The Advisory Group held their quarterly meeting on December 7. The major topic focused on the results of MBE/WBE participation in County construction since the goals program was established. There was also a discussion of the MBE/WBE program being established for County services contracts. b. Site Acquisition The Court of appeals has scheduled January 24, 1989 for oral arguments to Marwais Steel Company's appeal on the adequacy of the EIR. The Sheriff and Project Manager prepared declarations as part of Supplemental papers filed by the County's attorney on December 15. 2.. Marsh Creek Detention Facility ♦ Wastewater Treatment Facility The scoping meeting for the Court ordered environmental impact report has not been issued due to the demands of other high priority work within the Community Development Department. -2- CONTRA COSTA COUNTY JUSTICE PROGRAM PROGRESS REPORT NO. 5 DECEMBER 1988 C. SCHEDULE: 1. {lest County Justice Center a. Design: The furnishing, equipment and signage Design Development presentation was made on December 2. A cost estimate for this scope of work is due in early January. b. Construction: 0 Contract A: Substantially complete. 2) Contract B: Construction contract critical activities were underslab electrical and communications conduits, foundation footing construction, first two courses of concrete block, slabs-on-grade and concrete block walls for the Administration Building. Recommendation of a 4 calendar day extension is made for Claim Number One. Detailed information is contained in Section II. 2. Harsh Creek Detention Facility a. Design ♦ Wastewater Treatment Facility John Carollo Engineers issued an interim sanitary sewer treatment system plan. The design incorporates a 9,000 gallon temporary holding tank and an underground leach pit with approximately 57,800 cubic feet of drain rock. The design review meeting with the County Departments is scheduled for the early weeks in January. ♦ Modular Dormitories The local fire district has approved the design of the revised fire sprinkler plans. Approval is contingent upon the available water quantity and pressure supplied by the Contra Costa Water District. -3- b. Construction Wastewater Treatment Facility The Contractor continued with the construction of the revised sanitary sewer line and fire service line. Several rainy days, poor soil conditions and many unknown utilities have caused delays in the construction schedule. Presently, the completion date is scheduled for 1/15/89; however, negotiations are scheduled for early January to review the schedule and revise the construction completion date as necessary. Modular Dormitories 1. Site Work:" Rough site grading and foundations were completed. All 60 modules were set onto foundations as of 12/23/88. Following negotiations, interim milestone dates were revised. The final completion date remains 2/18/89. 3. Martinez Detention Facility a. Design The Architectural Services Agreement for the Contract Documents, Bidding and Construction Phases of the project will be awarded following the ongoing County Counsel review. D. FINANCIAL: 1. Martinez Detention Facility Professional Services Budget: $200,000 Encumbered to Date: 95,440 Expenses Reported: 28,920 E. MAJOR AREAS OF CONCERN: 1. West County Justice Center: ♦ Contract A: Oliver de Silva, Inc. a. Storm Drain in the Park: Problem: The storm drain in the park was extended, but the outlet of the pipe is lower than adjacent grades and causes ponding. Action: The CM has contacted Southern Pacific Railroad for permission to cut a drainage ditch within their right-of-way. S.P.R.R. approved the request and is processing right-of-entry documents. b. Street Light Photocells: Problem: Four (4) street lights installed along Giant Highway do not automatically turn-off because photocells have not been provided. The Contractor contended that the contract design does not indicate the circuiting for the type of photocells specified. Action: The CM directed the Contractor to install the photocells. ♦ Contract B: Walsh Construction Company a. Plumbing & Structural Conflicts (Claim One): Problem: Contractor claimed 24 days and $59,000 due to alleged conflicts between the underground plumbing and structural footings. -5- CONTRA COSTA COUNTY JUSTICE PROGRAM PROGRESS REPORT NO. 5 DECEMBER 1988 Contract B: Walsh Construction Company(Cont'd) Action: Claim settled at $25,000 and a four (4) day time extension. CM is 'preparing the change order documents. b. Progress Schedule Slippage: Problem: Per the Contractor's 12/25/88 CPM schedule update, the Contractor is still 14 calendar days behind schedule. Action: The CM and Contractor have developed work around solutions to expedite the work by making concrete block activities concurrent rather than sequential with slab concrete work. It is forecasted that the Contractor may regain lost time by expediting the block work. In addition, a four (4) day contract time extension is recommended for Claim No. One above. C. Inclement Weather Delay: Problem: Winter rain adversely affected the progress of the work during this report period. Action: The CM is monitoring the days lost due to rain. Appropriate contract time extensions will be recommended to the County. d. Lack of Manpower: Problem: The Contractor is not providing adequate crewing for electrical, communication and block wall. Action: The Contractor has been put on notice that the original planned crewing must be maintained. In addition, the CM is monitoring the planned versus actual crewing each week with the Contractor. e. Electrical Room Equipment Clearance Claim: Problem: County code inspector stated the Contractor's layout for electrical equipment will not meet code clearance requirements. The Contractor is claiming foundation demolition cost and a six (6) day delay stating that the room size as originally designed was too small. Action: The CM, AE and electrical subcontractor completed the reconfiguration of the electrical equipment layout to meet the code requirement. CM has rejected the Contractor's claim since the Contractor had two obligations: (1) to meet the technical requirements for the electrical equipment and (2) to select electrical equipment that fits within the prescribed space. -6- CONTRA COSTA COUNTY JUSTICE PROGRAM PROGRESS REPORT NO. 5 DECEMBER 1988 Contract B: Walsh Construction Company(Cont'd) f. Fire Riser Room Claim: Problem: The Contractor alleges that the fire riser equipment, as designed, will not fit in the allotted space without reconfiguration and claims extra costs for relocation of equipment. Action: The CM has rejected the claim because the specifications require the Contractor to design and build the fire protection system. g. Cell Door Lock Change: Problem: The program requires that mechanical override be provided for cell doors, however, the contract documents specify a lock but no cylinder. In November, AE proposed adding a cylinder and a cylinder extension to the lock to provide a mechanical override for each of the affected 480 cell doors. Action: CM has instructed the contractor to price the proposed change. h. Letter of Credit: Problem: Contractor has proposed a letter of credit as a substitution for the retention from the monthly progress payment. A copy of the draft letter was sent to County Counsel on November 23. Action: County Counsel is reviewing the proposal. i. Soil Amendment Claim: Problem: The Contractor states the contract documents do not require soil amendments for the meadow grass or shrubs areas and claims about $15,000. Action: The CM and the landscape consultant met with Walsh and the landscape subcontractor and agreed with the Contractor's interpretation. Subsequently, AE modified the specification for the fertilizer. Price quotation is pending from the Contractor. j . Code Inspection Delay: Problem: On December 12th, due to computer error at the County Inspection Department, the County Inspectors could not perform the inspection of the concrete blocks in time. This held up the wall concrete block grout pour for one (1) day. The Contractor claimed a delay. -7- C O N T R A C O S T A C O U N T Y J U S T I C E P R O G R A M PIZOGRFSS REPORT NO. 5 DECEMBER 1988 Contract B: Walsh Construction Company(Cont'd) Action: The CM agreed that a one (1) day time extension will be recommended to the County. 2. Marsh Creek Detention Facility: ♦ Modular Dormitories a. Fire District Approval: Problem: The local fire district conditionally approved the design of the dorms' fire sprinkler service. The fire district is concerned that the available water pressure and flow will not be able to simultaneously provide for both the fire hydrants and the fire sprinklers. Action: The CM is coordinating additional water pressure and flow studies with the Contra Costa Water District and John Carollo Engineers to determine how the fire water pressure and flow can be increased. b. Foundation Inspection: Problem: The Building Inspection Department inspected all rebar and foundation forms for Dorm No. 2 and one-half of Dorm No. 1 on 12/15/88. This work was approved; however, on 12/16/88 a follow up inspection was scheduled to review the remaining half of Dorm No. 1. The building inspector arrived on the site after the concrete for Dorm No. 1 had been poured. Consequently, a Stop-Work Notice was issued by the Building Inspection Department on 12/23/88. Action: The CM was on-site when all steel work within Dorm No. 1 foundation was completed and assured the Building Inspection Department that all rebar placement was consistent with the approved sections of both Dorm No. 2 and Dorm No. 1. The County's Building Inspection Department and the CM have scheduled a meeting on 12/27/88 to review the status of the building permit. C. Delayed Milestone/ Revised Construction Schedule: Problem: The contract interim milestone 3 (installation of the modular buildings) was scheduled for 11/14/88. This milestone slipped to 12/23/88. Action: Negotiations were finalized on 12/17/88, when the contractor reevaluated the construction schedule and concluded that all current delays can be made up during the remaining construction period. The project completion date remains as scheduled on 2/18/89. As a result of accepting the revised schedule, the County will not assess any liquidated damages against the interim milestone dates behind schedule. -8- CONTRA COSTA COUNTY JUSTICE PROGRAM PPROGRFSS REPORT NO. 5 DECEMBER 1988 ♦ Wastewater Treatment Facility a. Delayed Milestone: Problem: Due to scope of work changes, several rain days, unknown utilities and poor soil conditions, the construction schedule has slipped approximately 30 calendar days beyond the January 15, 1989 completion date. Action: The CM has arranged negotiations with the contractor in early January to revise the schedule and establish a new completion date. b. Interim Sewage Treatment Design: Problem: The interim sewage treatment design consisting of a temporary septic tank and leach pit is designed to treat approximately 10,000 gallons per day. This volume increase is to protect against system failure and was not meant to allow for facility population expansion. GENERAL: The detailed schedule report is subdivided by three projects: 1) West County Justice Center, 2) Marsh Creek Detention Facility and 3) Martinez Detention Facility. The three projects are further divided into the design and construction phases. The design portion will include general design data and a progress narrative. The construction section will be subdivided by each contract and will provide contract data, a progress narrative, plus a bar chart. 2. West County Justice Center a. Design: The furnishing, equipment and signage Design Development phase presentation was made to the Sheriff's Department on December 6. The general scope was approved in concept. The consultant's cost estimate is due the second week in January. b. Construction: The West County Justice Center project includes two contracts: 1) The first contract was for the rough grading of the project site (Contract A), which is substantially complete. 2) The second is for the construction of the detention facility (Contract B). PROGRESS NARRATIVE a. Building One (Administration Building): Underslab electrical and communication installation was about 957 complete at the west side and 907 complete at the east side. Underground plumbing installation was approximately 987 complete. Foundation footing construction was about 957 complete. The first two courses of concrete blocks were 957 complete at the west side and 907 complete at the east side. Slab-on,-grade installation was 807 complete at the west side and 507 complete at the east side. Installation of hollow metal door frames was 957' complete at the west side. While a four (4) calendar day delay has been assessed against the underground plumbing/structural conflicts, additional schedule slippage observed for Building No. 1 (due to the Contractor's unsatisfactory progress) in the last report period has not been reduced. CM is monitoring the schedule closely. b. Building Two (Medical/Dental/Library/Classroom Building): Foundation footing construction was complete. First two courses of masonry remain 507 complete. Underslab plumbing is 987 complete. Underslab conduit is 907 complete. C. Building Three (Multi-purpose Building): Foundation footing construction was complete d. Building Four (Inmate Housing/Central Visiting): Slab-on-grade pours were complete. Exterior concrete block wall first lift was 907 complete. Above-ground plumbing was 257 complete. Installation of hollow metal frames was 407 complete. e. Building Five (Inmate Housing): Exterior concrete block wall first lift was 957 complete. f. Building Six (Inmate Housing): Slab-on-grade pours for the wings were complete. Exterior concrete block wall first lift was 957 complete. g. Building Seven (Inmate Housing): Slab-on-grade pours for the wings were complete. Exterior concrete block wall first lift was 957 complete. h. Building Eight (Inmate Housing): Exterior concrete block wall first lift remained 957 complete. i. Site Utilities: No additional progress for storm drain system, sanitary sewer system, and site waterline. Site gasline system has not yet started. Site underground electrical installation was 1007 complete. Site underground communication conduit installation was approximately 907 complete. j. Site Work: Due to winter rain, there was little progress on site work. -16- CONTRA COSTA COUNTY JUSTICE PROGRAM PROGRESS REPORT NO. 5 DECEMBER 1988 C. Areas of Concern 1). CPM Schedule: Problem: The initial CPM schedule was rejected due to questionable activity durations and logic, crew loading and cost loading. Action: The Contractor has resubmitted the schedule, cost loading and manpower loading for the CM's review. 2). Communication Multiplex Unit Problem: The Contractor stated the specified multiplex unit cannot provide the specified performance and is no longer made. The Architect tentatively agreed to upgrade the multiplex unit pending contractor's submittal of a technical proposal. Action: The CM instructed the Contractor to expedite the proposal submittal. 3). Carpet Submittal Problem: The substitute carpet submittal does not meet the specified carpet in both color and texture. Action: The Contractor has been directed to resubmit to match the specified carpet. 4). Loading Dock Concrete Block Types Problem: Due to concrete block delivery problems, the Contractor proposed to substitute precision blocks at the loading dock with colored split-face concrete block. Action: Contractor's proposal was accepted by the County, CM and AE to help expedite the work. 5). Exception Notice No. 21 Problem: The Contractor placed aged-and-rejected concrete in the footings of a store room at the south east corner of Building 1. Action: CM directed the Contractor to remove the bad concrete and replace with good concrete, and issued a serious warning to the Contractor. 6). Silt Deposit into Storm Drain System Problem: Silt was carried by the storm runoff into the storm drainage system. Action:', CM directed the Contractor to take erosion control measures to stop and prevent continued silt deposit and to clean up the storm drains., -17- C 0 N T R A C 0 S T A C 0 U N T Y J U S T I C E P R O G R A M PROGRESS REPORT NO. 5 DECEMBER 1988 7). Water Heater and Storage Tank Submittal Problem: The Contractor disagreed with the AE's rejection of the subject submittal and stated that they had submitted the tanks per the specified performance requirement. Action: The AE agreed to re-evaluate the Contractor's submittal. 3. Marsh Creek Detention Facility a. Design ♦ Modular Dormitories Final approvals were forwarded by the local fire district on 12/2/88. Areas of Concern 1). Kitchen Equipment Problem: The Architect changed the quick chill refrigerator and carts in response to the County's request. Action: The CM requested the Contractor to submit a price quotation for the change. 2). Seven (7) Steel Windows Problem: ' AE and the County requested that seven (7) windows be withheld from fabrication pending redesign. Action: AE has been put on notice to expedite the redesign. 3). Sprinkler Pipe Hanger Problem: The Contractor proposed to use hanger rods dropped through the metal decking to hold sprinkler head piping. Proposal was rejected by the AE as the proposal does not meet NFPA (National Fire Protection Association) structural loading requirement. The Contractor stated that in order to meet this loading requirement, the specified roofing system must be strengthened. Action: The AE has directed the Contractor to provide additional steel supports as per the intent of the specifications to hold the hanger rods. 4). Door Position Switch Problem: The sally port and exterior doors were prepared for the wrong door position switch.
