FROM: Phil Batchelor, County Administrator Costa I.: ?5 .; - County DATE: April 24, 1989 ST9 COUN� _ SUBJECT: LEGISLATION: SB 1620 (Lockyer) SPECIFIC REOUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION RECOMMENDATION: Adopt a position of SUPPORT for SB 1620 by Senator Bill Lockyer which would simplify the method of distributing fines and forfeitures to the county, cities and various other funds. BACKGROUND: The bookkeeping which is required to precisely distribute each and every dollar of fine and forfeiture revenue which is currently received by the courts is extremely detailed and tedious. A single payment, depending of the offense, can require distribution to a dozen or more separate funds, requiring a dozen or more separate calculations. These are time consuming and open to error. Senator Lockyer has introduced SB 1620 which would substantially simplify and reduce this time consuming work by allowing the court to distribute the revenue on the basis of a percentage. formula, based on historical trends, as long as the formula results in substantially the same distribution of money otherwise required by law. These percentages could be checked regularly for accuracy and would have to be revised and updated as the law changes the distribution of fines and forfeitures. The Municipal Court Administrator supports SB 1620 and has recommended that the Board of Supervisors also support SB 1620 as an effective effort to streamline the distribution of fines and forfeitures and make the courts even more efficient. This office concurs with this recommendation and therefore recommends that the Board indicate its support for SB 1620.
