SUBJECT: LEGISLATION: SB 39 (Doolittle)
SPECIFIC REQUEST(S)OR RECOMMENDATION(S)&BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Adopt a position in OPPOSITION to SB 39 by Senator Doolittle which requires
that elementary, high school and community college district employees have
an HIV test as a part of the currently required tuberculin test, that the
county' s child health and disability prevention program provide for HIV
tests as a part of the screening for tuberculosis, allows the health
officer to include a test for the HIV virus in a test for tuberculosis on
children entering school who are reasonable suspected of having
tuberculosis, would require the HIV test be included in the tuberculin test
for all employees in private schools as well as for persons employed in
connection with a park, playground, recreation center or beach who are in a
position to come in contact with children or as a food concessionaire or
other licensed concessionaire in those areas.
BACKGROUND:
Under current law a wide variety of individuals who may come in contact
with children are required to have an intradermal tuberculin test which, if
positive, is required to be followed by a chest X-ray.
Senator Doolittle has introduced SB 39 which includes as a part of the
tuberculin test a test for the presence of the HIV virus. The County
Health Officer, Dr. William Walker, in his capacity as President of the
Health Officers Association of California, has indicated that that
organization has taken a position in opposition to SB 39, as has the
County' s Health Services Director, Mark Finucane.
In opposing SB 39 Dr. Walker has indicated that "the bill adds nothing to
the battle against HIV epidemic or to tuberculosis control. It is
unscientific and poorly conceived and should �be opposed. "
