HomeMy WebLinkAboutMINUTES - 05021989 - 1.1 (2) THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on May 2, 1989 by the following vote: AYES: Supervisors Powers , Fanden, Schroder and Torlakson NOES: None ABSENT: Supervisor McPeak ABSTAIN: None SUBJECT: Approving Deferred Improvement Agreement at the intersection of Oakley Road and Empire Avenue, for Subdivision 7045, Oakley Area. Assessor's Parcel No. 035-011-020. The Public Works Director has recommended that he be authorized to execute a Deferred Improvement Agreement with Northern California Development Company, as required by the Conditions of Approval for Subdivision 7045. This agreement would permit the deferment of construction of a traffic signal at the intersection of Oakley Road and Empire Avenue, in the Oakley area. IT IS BY THE BOARD ORDERED that the recommendation of the Public Works Director is APPROVED. The Final Map of Subdivision 7045, property located in the Oakley area, said map having been certified by the proper officials. II. A Subdivision Agreement with Northern California Development Company , subdivider, whereby said subdivider agrees to complete all improvements as required in said Subdivision Agreement within one year from the date of said agreement. Said agreement was accompanied by security to guarantee the completion of road and drainage improvements as required by Title 9 of the County Ordinance Code, as follows: A. Cash deposit (Auditor's Deposit Permit No. 155199, dated April 14, 1989) in the amount of $4,500 made by Northern California Development Company. B. Additional security in the form of a corporate surety bond dated March 27, 1989, and issued by Insurance Company of the West (Bond No. 113 31 63) with Northern California Development Company as principal, in the amount of $450,800 for faithful performance and $227, 650 for labor and materials. III. A Road Improvement Agreement with Northern California Development Company, developer, whereby said developer agrees to complete all improvement as required in said Road Improvement Agreement within one year from the date of said agreement. Improvements generally consist of median island construction and landscaping on Highway 4 (Main St. ) . Said agreement was accompanied by the following security to guarantee the completion of road and drainage improvements as required by Title 9 of the County Ordinance Code, as follows: A. Cash deposits (Auditor's Deposit Permit No. 155199, dated April 14, 1989 in the amount $243.73, and Auditor's Deposit Permit No. 155256, dated April 17, 1989 in the amount $756.27) both made by Northern California Development Company. B. Additional security in the form of a corporate surety bond dated April 10, 1989, and issued by Insurance Company of the West (Bond No. 112 84 72) with Northern California.-__-Development Company as principal, in the amount of $'24, 372 .50 for faithful performance and $12, 186.25 for labor and materials. RESOLUTION NO. 89/278 IV. Letter from the County Tax Collector stating that there are no unpaid County taxes heretofore levied on the property included in said map and that the 1988-89 tax lien has been paid in full and the 1989-90 tax lien, which became a lien on the first day of March, 1989, is estimated to be $22,400. V. Security to guarantee the payment of taxes as required by Title 9 of the County Ordinance Code in the form of a cash deposit (Auditor's Deposit Permit No. 155237, dated April 17, 1989) made by Diversified Shopping Centers in the amount of $22,400 guaranteeing the payment of the estimated tax; NOW THEREFORE BE IT RESOLVED that said subdivision, together with the provisions for its design and improvement, is DETERMINED to be consistent with the County's general and specific plans. BE IT FURTHER RESOLVED that said Final Map is APPROVED and this Board does not accept or reject on behalf of the public any of the streets, paths, or easements shown thereon as dedicated to public use. BE IT FURTHER RESOLVED that said Subdivision Agreement is also APPROVED. 1 hereby certify that this is a true and correct copy of an action taken and entered on the minutes of the Board of Supervisors on the date shown.
