(Applicant & Owner) , of Minor Subdivision 103-88, to divide 5.2 acres of land located on the west side of Sandmound Boulevard, approximately 700 feet north of that road's most southerly terminus, into 4 lots with lot area variances on all four parcels and average lot width variance on Parcel D. (Parcel #032-340-009) . SPECIFIC REQUEST(S) OR RE (S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS 1. Accept the environmental documentation as adequate. 2. Deny the appeal of Ranchetts Unlimited, Inc. and sustain the decision of the East County Regional Planning Commission to deny Application #MS 103-88. BACKGROUND/REASONS FOR RECOMMENDATIONS This minor subdivision was denied by the Zoning Administrator on December 19, 1988. The Zoning Administrator denied the application because inconsistency with the East County Area General Plan and the A-2 (General Agricultural) Zoning. The East .County Regional Planning Commission visited the subject property and sustained the decision of the Zoning Administrator on January 23, 1989, CONTINUED ON ATTACHMENT: YES SIGNATt3 l RECOMMENDATION OF COUNTY ADMINISTRATOR REC OF COMMIT'T'EE APPROVE OTHER SIGNATURE(S) : ACTION OF BOARD ON May 2 1929 APPROVED .AS..,REGOMII�ENDED . ---07 HER This being the time heretofore noticed by the Clerk of the Board of Supervisors for hearing on the appeal of Charles Pringle representing Ranchettes Unlimited, Inc. from the East County Regional Planning Commission decision upholding the decision of the Zoning Administrator denying a request by Ranchettes Unlimited, Inc. (applicant and owner) for approval of a four lot minor subdivision with lot area variances on all four parcels and average lot width variance on Parcel D (Minor Subdivision 103-88) in the Oakley area. Mary Fleming, Community Development Department, presented the staff report on this item to the Board. She commented on the history of the request, described the project site and presented the staff recommendation that the Board accept the environmental documentation as adequate and deny the appeal of Ranchettes Unlimited, Inc. and sustain the decision of the East County Regional Planning Commission. The public hearing was opened and the following persons appeared to speak: Charles Pringle, P.O. Box 658, Brentwood, appellant/applicant, commented on issues including the General Plan, size of surrounding properties, water and sewer access, the utility criteria, the different zoning on the parcel and he requested approval of the minor subdivision. Supervisor Torlakson requested clarification on the issue of the .General Plan and the zoning being inconsistent. Karl Wandry, Community Development Department, responded that no CEQA review was done on the project as it is not an approvable project because it is not consistent with the General Plan. He commented that the criteria for utilities applies in residential areas in the East County Plan not agricultural or agricultural residential areas. Charles Pringle spoke in rebuttal. The public hearing was closed. Supervisor Torlakson moved to deny the appeal based on the consistency issue. He then amended his motion to include the referral of a letter received from JoAnn Brady dated May 16, 1989 relative to this matter to the Community Development Department. IT IS BY THE BOARD ORDERED that recommendation 1 and 2 are APPROVED; and the letter relative to this matter from JoAnn Brady dated May 16,1989 is REFERRED to the Community Development Department.
