BACKGROUND: Attached is a copy of Progress Report#7,for the month of February 1989, setting forth some of the concerns which have surfaced regarding time!delays in the construction and other relatively minor problems which are being negotiated with various contractors. All work still appears to be within budget and very nearly on schedule. INTRODUCTION: This report is subdivided into three major sections: 1) Executive Summary, 2) Detailed Schedule and Financial Information and 3) Attachments. It describes the design and construction progress for the West County Justice Center, Marsh Creek Detention Facility and Martinez Detention Facility achieved during the period of February 1989 as well as Areas of Concern. B. GENERAL: 1. Marsh Creek Detention Facility a). Wastewater Treatment Facility The interim wastewater treatment facility has been completed and will be utilized until additional project funding is budgeted for the long range project. The required environmental studies will be done at this later time. b). Masterplan The final masterplan draft was reviewed by the Sheriff's Department and inmate programs staff. Construction ♦ Wastewater Treatment Facility The Contractor completed construction of the interim wastewater treatment facility on February 17. Replacement of pavement is the only outstanding construction item remaining. ♦ Modular Dormitories The Contractor has completed approximately 85% of the total project. Negotiations concluded with a revised completion date of March 15, 1989 due to rain delays and unforeseen site' conditions. 3. Martinez Detention Facility a. Design The Architectural Services Agreement for the Contract Documents, Bidding and Construction Phases of the project is being reviewed by County Counsel. The agreement will be awarded as soon as this pending review is complete and accepted by the Architect. D. FINANCIAL: 1. West County Justice Center a. Design: A furniture and signage budget was submitted on January 19 with revisions (listing alternatives) submitted on January 25 and February 23. The Sheriff's Department, Architect and Project Manager continued to review and refine the furniture, equipment and signage list in February. The revised equipment list will be returned to the Architect in early March. b. Construction: 1) Contract A: Substantially complete. 2) Contract B: Construction contract critical activity was installation of concrete block walls at the east half of the Administration Building. Marsh Creek Detention Facility a. Design ♦ Wastewater Treatment Facility All phases of design have been completed until the long range project is reactivated. ♦ Modular Dormitories On February 23, the local fire marshal reviewed the design for the proposed fire service line and concluded that Contra Costa Water District should connect their water main to the new fire service line. -4- CONTRA COSTA COUNTY JUSTICE PROGRAM PROGRESS REPORT NO. 7 FEBRUARY 1989 3. Martinez Detention Facility Professional Services Budget: $200,000 Encumbered to Date: 95,440 Expenses Reported: 29,440 D. MAJOR AREAS OF CONCERN: 1. West County Justice Center: ♦ Contract A: Oliver de Silva, Inc. a. Storm Drain in the Park: Issue: The Park requested that the rock rip rap wall at the inlet to the storm drain in the park be replaced with sacked concrete to prevent erosion. Action: The CM confirmed that the design engineer's intention was to use a sacked concrete headwall. This, in turn, required the extension of an existing park storm drain at the inlet end. The CM negotiated a price for the change with the Contractor. The work will be carried out when weather permits. b. Erosion Repair: Issue: Erosion-control hay bales were not properly installed by ODS and storm runoff silted up an area adjacent to the Park's trail road. Action: The CM directed ODS to replace hay bales and remove the silt build-up. The repair was close to completion by the end of February. C. Raise Catch Basin Issue: The catch basin installed per contract on Giant Highway was lower than the road by six (6) inches and was a potential traffic hazard. -6- C 0 N T R A C 0 S T A C O U N T Y J U S T I C E P R O G R A M PROGRESS REPORT NO. 7 FEBRUARY 1989 Contract A: Oliver de Silva, Inc.(Cont'd) Action: The design engineer recommended raising the catch basin. A price quotation was received from the Contractor and is being reviewed by the CM. ♦ Contract B: Walsh Construction Company a. Status of Progress: Issue: As of the end of February, the CM's analysis indicates the Contractor has regained the time he lost in previous months and his progress is on schedule. b. Electrical Room Equipment Clearance Claim: Issue: Per County Code Inspector's requirement, the Contractor's layout for electrical equipment had to be reconfigured to meet code clearance requirements. The Contractor submitted a claim requesting $17,203 including foundation demolition and overhead costs plus a six day delay, stating that the room size as originally designed was too small. Action: CM is negotiating a settlement with the Contractor. C. Fire Riser Room Claim: Issue: The Contractor alleges that the fire riser equipment, as designed, will not fit in the allotted space without reconfiguration and claims extra costs for relocation of equipment. Action: Initially, the CM rejected the claim because the specifications require the Contractor to design and build the fire protection system. After detailed review, the AE agreed that relocation of some of the equipment is necessary. Price quotation is pending from the Contractor. d. Cell Door Lock Change: Issue: In November 1988, a design change proposal was issued to add a cylinder and a cylinder extension to the inmate cell door locks to provide a mechanical override. Action: The design change proposal was rescinded when the AE confirmed that the base contract wall mounted key switches would perform the same function. e. Letter of Credit: Issue: Contractor has proposed an irrevocable letter of credit as a substitution for the retention from the monthly progress payment. Action: County Counsel's comments have been sent to the Contractor recommending some changes. If acceptable to the Bank, the letter of credit should be executed in March. -7- CONTRA COSTA COUNTY JUSTICE PROGRAM PROGRESS REPORT NO. 7 FEBRUARY 1989 Contract B: Walsh Construction Company(Cont'd) f. Fire Protection System Design: Issue: The contract design provides for a dry standpipe off the sprinkler system whereas the fire codes require a separate wet standpipe system to service hose reels. Therefore, the Contractor's shop drawings were rejected by the Fire Marshal. The Fire Marshal has accepted the alternate proposal to service wet hose reels by tapping into the wet portion of the standpipe. Action: The AE redesigned to add the hose reels and found potential conflicts with as-built components. The AE proposed using fire extinguishers as a substitution for the hose reels. AE's proposal was approved in concept by the State Fire Marshal and is being considered by the local Fire Marshal. The Contractor has indicated this design change will result in extra costs. g. Sales Tax Increase Issue: The Contractor requested the County to consider reimbursing the Contractor for the additional sales tax which will be incurred for the unpurchased materials in the base contract material due to the recent sales tax increase from 6.57 to 77 in Contra Costa County. Action: The CM directed the Contractor's request to County Counsel for review. h. County Trees: Issue: All trees to be provided by the County were rejected by the AE and subcontractor . Action: The CM and the Contractor negotiated a price of $19,400 for supplying these replacement trees. i. County Furnished Items: Issue: Since they had not been ordered, the CM proposed the inclusion of several pieces of County furnished equipment (trash compactor, clothing conveyance unit and spray booth) into Walsh's contract for better scheduling and coordination. Action: Upon County's approval, the CM authorized the AE to 'prepare the technical documents for the proposed change. j. Floor Coverings: Issue: The interior design, which is taking place after the award of the contract, is affecting the type of carpet and tile plus color. -8- CONTRA COSTA COUNTY JUSTICE PROGRAM PROGRESS REPORT NO. 7 FEBRUARY 1989 Contract B: Walsh Construction Company(Cont'd) Action: The AE was put on notice to use specified materials and to make a timely selection of the colors. The tiles have been selected. - The carpet resubmittal/selection is close to completion. k. Multiplex Unit: Issue: After meeting with the communication subcontractor, the AE confirmed a conflict between the listed multiplex unit and the specified requirements. Action: The Contractor has indicated additional costs will be claimed. 1. Ridge Line and Steel Beam Elevation Conflict: Issue: A conflict exists between the roof ridge line and the top of the roof steel beam at Buildings 1, 2, 3 and 4. The AE provided a detail which suggests the use of angle plates to maintain the ridge line. The Contractor claims this detail constitutes an extra to the contract. The AE recommends rejecting the claim on the basis that the contract requires the contractor to provide the means to maintain the roof line. Action: The CM is reviewing the contract drawings and specifications to determine if this claim is valid. M. Cell Door Strike Cover Plate Issue: The AE added strike cover plates to the secured cell doors to eliminate potential tampering by inmates. Action: The CM instructed the Contractor to price the proposed change. The preliminary price quotation was in the range of $11,000 to $14,000. n. Security/Communication Submittals Issue: The Contractor's technical submittals for the security/communication systems are behind schedule. Action: The CM directed the Contractor to expedite submittals and requested a new schedule. o. Toilet Accessories Substitutions Issue: AE stated the proposed substitution is inferior to the specified brand. The Contractor disagreed on the basis that the substitutions are from an approved manufacturer. The Contractor will claim for extra costs if the specified brand must be used. -9- CONTRA COSTA COUNTY JUSTICE PROGRAM PROGRESS REPORT NO. 7 FEBRUARY 1989 Contract B: Walsh Construction Company(Cont'd) Action: The CM has instructed the Contractor to respond to the AE's review. In addition, the AE was requested to comment on all items submitted by the Contractor. 2. Marsh Creek Detention Facility ♦ Modular Dormitories a. Unavoidable Delays Issue: The original contract completion date was February 18. However, rain delays and unforeseen site conditions have affected the critical path activities from meeting the scheduled completion date. Action: During negotiations concluded on February 13, both the Contractor and CM agreed to revise the completion date to March 15, 1989. b. Anticipated Pavement Delays Issue: Excessive rain and saturated soil conditions have created poor soil conditions for site grading and paving. Also, the native clay soil will take a long time to dry and stabilize before it can support a flexible asphalt pavement system. Action: Both the CM and the Soils Inspector will continue to monitor the site grading and soil conditions for the most suitable paving conditions. Also, a possible alternative paving system will be evaluated for its potential to expedite the completion of the site work. ♦ Wastewater Treatment Facility a. Fire Service Line Issue: The Contractor is nearing completion of his construction but the Contra Costa Water District (CCWD) has not scheduled related construction of the fire service hook up. Action: The CM directed the Contractor to install a cross connection between an existing fire service line and the new 8 inch fire service line to allow some fire protection during construction of the Modular Dormitories. Also, since all work is nearing completion and is paid for on a time and materials basis, the Contractor was directed to complete all backfill and compaction of the new 8 inch fire line connection. The CCWD hook up remains uncertain due to internal scheduling and the issue of adequate fire water flow rates. G12E RAL: The detailed schedule report is subdivided by three projects: 1) West County Justice Center, 2) Marsh Creek Detention Facility and 3) Martinez Detention Facility. The three projects are further divided into the design and construction phases. The design portion will include general design data and a progress narrative. The construction section will be subdivided by each contract and will provide contract data, a progress narrative, plus a bar chart. 2. West County Justice Center a. Design: The Design Development Phase for furnishings, equipment and signage approval and start of Contract Documents Phase work was originally scheduled to occur on January 17. Based on a high cost estimate, both the County and Architect are conducting line item reviews necessary to reduce the cost. During this process, the Sheriff's Department discovered a number of required equipment items not included in the list, thus further increasing the budget. The elimination or reduction of many items have been identified. Final adjustments should be made the first week of March. The budget adjustment process will extend the start of the next phase of work by 30 - 45 days. b. Construction: The West County Justice Center project includes two contracts: 1) The first contract was for the rough grading of the project site (Contract A), which is substantially complete. 2) The second is for the construction of the detention facility (Contract B). PROGRESS NARRATIVE a. Building One (Administration Building): Slab-on-grade construction was complete except for the concrete paving at the vehicle sallyport. Concrete block wall construction was on schedule; 96% complete at the west side and 38% complete at the east side. Building Two (Medical/Dental/Library/Classroom Building):Slab-on-grade construction was 99% complete. C. Building Three (Multi-purpose Building): Slab-on-grade construction was 100% complete. d. Building Four (Inmate Housing/Central Visiting): There was little change in status at this building. The Contractor's progress effort was at other buildings. e. Building Five (Inmate Housing): Exterior concrete block walls were 100% complete up to the second floor level, with the exception of the entrance area. Structural steel to the second floor was 85% complete. f. Building Six (Inmate Housing):, Exterior concrete block walls were complete up to the second floor level except for the entrance area. g. Building Seven (Inmate Housing): Exterior concrete block walls up to the second floor level were 67% complete. h. Sprinkler Pipe Hanger Issue: The Contractor porposed to use hanger rods dropped through the roof metal decking to hold sprinkler head piping.
