THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA
Adopted this Resolution on May 23, 1989 by the following vote:
AYES: Supervisors Powers , Fanden, Schroder, McPeak & Torlakson

ABSENT: None
ABSTAIN: None RESOLUTION NO. 89/328
SUBJECT: Exonerate Offsite Right-of-Way Agreement, for
Subdivision 5946, Oakley Area.
On November 18, 1986, the Board authorized the Public
Works Director to execute an Offsite Right-of-Way Agreement with
Hal Porter Development Company to acquire additional right-of-
way for widening along Laurel Road between Subdivision 5946 and
State Highway #4 as required by the conditions of approval for
Subdivision 5946.
Said agreement was secured with a $10, 000 partially
refundable cash deposit to be used by the County as needed to
assist the developer in preparation for possible condemnation.
The Public Works Director now informs this Board that
the requirements outlined in said agreement have been satisfied.
The Public Works Director further informs this Board
that the Public Works Department has charged $944 .94 against the
$10, 000 cash deposit and anticipates no further charges.
The Board hereby FINDS that the conditions of the
above-mentioned Offsite Right-of-Way Agreement are satisfied.
NOW THEREFORE BE IT RESOLVED that the aforesaid
Deferred Improvement Agreement is EXONERATED.
BE IT FURTHER RESOLVED that the Public Works Director
is authorized to refund $9, 055. 06 from the original $10, 000 cash
deposit (Auditor's Deposit Permit No. 115412 dated October 22,
1986) plus interest in accordance with Government Code Section
53079, if appropriate, to Hal Porter Development Company.
I hereby certify that this is a true and correct copy of
an action taken and entered on the minutes of the
Board of Supervisors on the date shown.
