SUBJECT: LEGISLATION: SB 1358 (Torres)
Specific Request(s) or Recommendations(s) & Background & Justification
RECOMMENDATION:
Adopt a position in SUPPORT of SB 1358 by Senator Art Torres which would establish a
comprehensive hate/violence reduction program in public and private postsecondary educational
institutions.
BACKGROUND:
On May 9, 1989 the Board of Supervisors referred to this office a request from the Human Relations
Commission that the Board of Supervisors indicate its support for SB 1358 by Senator Art Torres.
SB 1358, as amended May 1, 1989, would do the following:
1. Require the Board of Governors of the California Community Colleges, the Trustees of the
California State University and the governing body of each private postsecondary educational
institution in California and authorize the Regents of the University of California to require
each campus under their jurisdiction to develop campus policies designed to encourage an
appreciation for all individuals, regardless of their race, ethnic background,national origin,
religious beliefs, sex, age, disability or sexual orientation and to prevent and respond to acts
of hate violence. D

2. Require each campus to adopt policies and procedures to discipline students or employees
who participate in acts of hate conduct.
3. Require each campus to establish procedures to prevent, report, monitor, evaluate and
respond to acts of hate violence.
4. Require the Board of Governors and the Trustees and authorize the Regents to submit a report
to the Legislature by July 15, 1991 on the steps which have been taken to implement these
requirements.
5. Require the establishment of system-wide Human Rights Advisory Boards which would
establish policies and procedures to maintain a fair and open environment on each campus
and prevent and respond to acts of hate violence. In addition,each campus would be required
to have a Campus Human Relations Board which would have similar responsibilities on an
individual campus to those which the Human Rights Advisory Board would have system-
wide.
6. Request the Academic Senates within each system to establish programs to promote racial
and cultural sensitivity and understanding in instructional and counseling programs, and
include these factors in evaluating faculty.
7. Require the Board of Governors and the Trustees and authorize the Regents to explore the
feasibility of developing an effective and reliable data collection system on hate violence
incidents and submit annual reports to the Legislature on reported acts of hate violence.
8. Require the submission of annual reports to the Department of Justice on specified crimes
occurring on each campus as well as acts of hate violence and to publish and distribute on an
annual basis a report on criminal statistics and crime rates for each campus over the past three
years.
Based on the Board's past support for programs which would address hate violence crimes in the
County and the fact that the Board has authorized the development of a model hate violence
prevention program in this County, it appears appropriate for the Board to indicate its support of
SB 1358.
