The Board of Supervisors on April 11, 1989 continued to this date the hearing on the appeal of John Rolf Hattam (appellant) from the decision of the Contra Costa County Planning Commission as the Board of Appeals upholding the decision of the Zoning Administrator on the request by John Rolf Hattam (applicant and owner) to build a second residence on a site retaining the existing 600 square foot residence (Land Use Permit 2070-88) , in the Kensington area. Karl Wandry, Community Development Department, presented the staff report on the request to establish the second residence on the site, described the site, and commented on the review by the Zoning Administrator, and the Planning Commission as the Board of Appeals. He commented on the staff recommendation to deny the appeal and maintain the denial on the application. Supervisor Schroder requested clarification of the basis of the Planning Commission' s recommendation. Mr. Wandry responded to Supervisor Schroder' s request relative to the concerns of the Planning Commission and the Zoning Administrator including the development of the site into two single family residences because of the steep slopes, a creek traversing the site and vegetation on the site. The public hearing was opened and the following persons appeared to speak: John Hattam, 37 Kingston Road, Kensington, appellant/applicant, commented on the request before the Board and on issues including no requirement of variances, the initial staff recommendation, and on a background summary he had presented to .each Supervisor at their office. He commented on the objections of the neighbors including increased traffic, fire hazard, lowered property values, privacy, esthetics, site suitability for construction, environmental concerns, and legality of the easement. He requested approval for his application. Supervisor Powers requested Mr. Hattam' s comments on pictures depicting a garbage truck stuck on the road. James Claytor, Lafayette, Attorney representing Mr. Hattam, commented on the width of the access road being constructed to whatever width the Fire Department or the Sheriff required. Supervisor Powers commented on the retaining wall height and requested clarification on the proposed height. Mr. Claytor responded to Supervisor Powers' request that the wall would be located on the front parcel where the easement goes over "and will be a retaining wall of approximately five to six feet in height on a downslope. Thomas Jukes, 170 Arlington Avenue, Kensington, spoke in opposition to the appeal, presenting written comments and a petition signed by twenty people in opposition to the land use permit. Marguerite Jukes, 170 Arlington Avenue, Kensington, spoke in opposition to the appeal and commented on a letter of opposition from Sam and Shelly Witten, 30 Sunset Circle, Kensington. Robert Hansen, 24 Kerr Avenue, Kensington, representing. the Kensington Improvement Club, spoke in opposition to the appeal. Bettine Kuh, 50 Sunset Drive, Kensington, spoke in opposition to the appeal and presented written comments for Board consideration. Alice Pasqualetti, 38 Sunset Drive, Kensington, spoke in opposition to the appeal and presented written comments for Board consideration. Charles Grant, 26 Sunset Drive, Kensington, spoke in opposition to the appeal, and requested that the Board deny the application of Mr. Hattam for a second residence. Mr. Hattam spoke in rebuttal, commenting on issues including Mr. Jukes petition, the legality of the easement, the number of houses requested on the property, and requested Mr. Claytor to finish the rebuttal. Mr. Claytor commented in rebuttal. The public hearing was closed. Supervisor Powers commented that members of the Board should have an opportunity to review the map and visit the site and expressed the desire to defer decision on this matter for a couple of weeks. Supervisor Schroder expressed agreement with visiting the proposed site. IT IS BY THE BOARD ORDERED that the hearing on the above matter is CLOSED and decision on the appeal of John Rolf Hattam relative to Land Use Permit application #2070-88 in the Kensington area is DEFERRED to the June 6, 1989 Determination Calendar.
