COSTA (Applicant) - ED JOHNSTON (Owner) - Walnut Creek area. (S. D. III) Parcel #138-060-006 SPECIFIC REQUEST S) OR RECO11MENIDATIONS(S) 6 BACKGROUND AND JUSTIFICATION RECOMMENDATIONS 1. Approve rezoning application 2815-RZ, ROBERT J. COSTA, (Appli- cant) , ED JOHNSTON (Owner) , as recommended by the County Plann- ing Commission on January 31, 1989. 2. Adopt the Planning Commission's findings as set forth in its resolution No. 16-1989, as the basis for the Board's decision. 3. Accept the environmental review documentation as being adequate. 4. Introduce the ordinance giving effect to the rezoning; waive reading and set date for adoption of same. JUSTIFICATION/BACKGROUND: This rezoning application was heard by the County Planning Commiss- ion on January 31, 1989. After taking testimony, the Commission unanimously recommended approval to your Board to rezone this 2.7 acre parcel from General Agricultural District (A-2) to Single Family Residential District (R-40) ,in accordance with the County Estate General Plan designation. It should be noted that adoption of this rezoning will enable the applicant to proceed with the subdivision of this site into three (3) parcels. The Zoning Administrator has previously approved M.S 82-88 for this site contingent on adoption of conforming zoning CONTINUED ON ATTACHMENT: YES SIGNA RECOMMENDATION OF COUNTY ADMINISTRATOR RECOMMENDATION O BOARD COMMITTEE APPROVE OTHER SIGNATURE(S) : ACTION OF BOARD ON May 16, 1989 APPROVED AS RECOMMENDED X OTHER This being the time heretofore noticed by the Clerk of the Board of Supervisors for hearing on the recommendation of the Contra Costa County Planning Commission on the request to rezone approximately 2.7 acres of land ( 2815-RZ) by Robert J. Costa (applicant) and Ed Johnston (owner) from General Agricultural District (A-2) to Single Family Residential District (R-40) in the Walnut Creek area. Karl Wandry, Community Development Department, described the site of the request, commented on the unanimous vote by the Planning Commission, and recommended that the Board approve the staff recommendations as presented. The public hearing was opened and no one appearing to testify, the public hearing was closed. ON recommendation of Supervisor Schroder, IT IS BY THE BOARD ORDERED that recommendations 1, 2, 3,. and 4 are APPROVED; and as in recommendation 4, Ordinance No. 89-29 is INTRODUCED, reading waived, and May 23, 1989 is set for adoption of same.
