SPECIFIC REQUEST S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION Receive the report from the Community Development Department on the statusof closure plans for the Richmond Sanitary Landfill and East County Sanitary Landfill. FISCAL IMPACT None to the County. - BACKGROUND/REASONS FOR RECOMMENDATIONS At its April 25, 1989 meeting, the Board of Supervisors requested staff to provide a status report on the closure plans for the Richmond Sanitary Landfill and the East County Sanitary Landfill. Both landfills have submitted their initial cost estimates for closure and postclosure (the actual plans are not due until July 1, 1990) . The initial cost estimates are $11.2 million for the East County Sanitary Landfill and $12 . 8 million for the Richmond Sanitary Landfill. These estimates were submitted to the California Waste Management Board within the past three weeks. Under State law, landfills are also required to submit documentation of financial assurance to fund the closure and CONTINUED ON ATTACHMENT: X YES SIGNATURE— ACTION IGNA -ACTION OF BOARD ON 2noz /6 APPROVED AS RECOMMENDED _><_ Supervisor Torlakson requested staff to send a letter on behalf of the Board to the State Waste Management Board expressing concern that the above referenced landfills have not submitted documentation on financial assurances to fund future closure and post closure activities. Supervisor McPeak requested the Director of Community Development to develop a recommendation for Board consideration on its role in reviewing and assessing landfill closure plans. Supervisor Powers requested information from County Counsel relative to the closure plan process and rate regulation, including the feasibility of establishing a trust fund or similar type mechanism for depositing closure fees collected. The requested information is to be provided June 6, 1989. Neither landfill has filed such sureties with the State ( the segregated account arrangement between Richmond Sanitary and the West County cities does not currently qualify as a financial surety) . The California Waste Management Board is currently preparing a list of delinquent landfills for the Attorney General' s office to pursue compliance. In addition, the California Waste Management Board is preparing regulations which will be effective on July 1, 1989 concerning appropriate mechanisms to achieve financial assurance. Under .State law, the Board has until July 1, 1990 (the due date for the actual closure plan) to determine the acceptability of the financial assurances, although it can act sooner. Hoffman Community Development Department Contra Costa County County Administration Building 651 Pine Street, 4th Floor, North Wing Martinez, CA 94553-0095 Dear Ms. Hoffman: This is in response to your letter , dated April 14, 1989, regarding clarification on closure and postclosure costs for Contra Costa County landfills. As you are probably aware all operators of solid waste landfills were required to certify to the California Waste Management Board (Board) and their local enforcement agency (LEA) by January 1, 1989, that they had prepared an initial cost estimate, established an interim financial mechanism, and that the funding of the selected mechanism would ensure adequate resources for closure and postclosure maintenance. Richmond Sanitary Services (West Contra Costa Landfill, 7-AA-0001) and Contra Costa Solid Waste, Inc. (GBF Disposal Site, 07-AA-0003 and Pittsburg Disposal Site, 07-AA-0004) are currently in violation of the certification requirements and compliance activities are underway. Preliminary screening of the Acme Fill Company (Acme Landfill, 07-AA-0002) submittal indicates that it includes all of the required elements of the certification and requested documentation. Board staff will be reviewing all complete submittals further to assess the reasonableness of the cost estimates and verify the establishment and the funding of the selected financial mechanisms. The results of these reviews will be presented to the Board for consideration of approving the operator certifications. Closure and postclosure plans, cost estimates revised to reflect the plans, and financial assurance consistent with the new regulations will be required beginning on July 1, 1990. A more detailed evaluation of the engineering and cost aspects will be undertaken in conjunction with consideration of the plans and financial mechanisms for approval by the Board at that time.
