HomeMy WebLinkAboutMINUTES - 05161989 - 1.14 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Resolution on May 16, 1989 by the following vote: AYES: Supervisors Powers , Panden, Schroder, McPeak & Torlakson NOES: None ABSENT: None ABSTAIN: None RESOLUTION NO. 89/316 SUBJECT: Approval of the Parcel Map and Subdivision Agreement for Subdivision MS 101-88, Lafayette Area, (APN 169= 080-003) . The following documents were presented for Board approval this date: The Parcel Map of Subdivision MS 101-88, property located in the Lafayette area, said map having been certified by the proper officials. A Subdivision Agreement with Diablo View Estates Investors, subdivider, whereby said subdivider agrees to complete all improvements as required in said Subdivision Agreement within one year from the date of said agreement. Said documents were accompanied by: I . Security to guarantee the completion of road and drainage improvements as required by Title 9 of the County Ordinance Code, as follows: A. Cash deposit (Auditor' s Deposit Permit No. 155868, dated April 28 , 1989) in the amount of $1, 000 made by R. W. and L. R. Spencer. B. Additional security in the form of a corporate surety bond dated April 26, 1989, and issued by Explorer Insurance Company (Bond No. 113 26 32) with Diablo View Estates Investors as principal, . in the amount of $35, 500 for faithful performance and. $18 , 250 for labor and materials. II . Letter from the County Tax Collector stating that there are no unpaid County taxes heretofore levied on the property included. in said map and that the 1988-89 tax lien has been paid in full and the 1989-90 tax lien, which. became a lien on the first day of March, 1989, is estimated to be $700 . III . Security to guarantee the payment of taxes as required by Title 9 of the County Ordinance Code in the form of a surety bond, No. 113 26 34, issued by Explorer Insurance Company with Diablo View Estates Investors as principal , in the amount of $700 guaranteeing the payment of the estimated tax; The Public Works Director has reported that necessary creek improvements alonoor the southerly property line of Subdivision MS 101-88 have not been addressed as required in the conditions of approval and recommends withholding building permits on this property until the scope of necessary creek improvements is known and those improvements are bonded or constructed; RESOLUTION NO. 89/316 NOW THEREFORE BE TT RESOLVED that said subdivision, together with the provisions for its design and improvement, is DETERMINED to be consistent with the County ' s general and specific plans. BE IT FURTHER RESOLVED that said Parcel Map is APPROVED and this Board does not accept or reject on behalf of the public any of the streets, paths, or easements shown thereon as dedicated to public use. BE IT FURTHER RESOLVED that said Subdivision Agreement is also APPROVED. BE IT ALSO ORDERED that the Building Inspection Department shall withhold the issuance of building permits on parcels subdivided from land. shown as APN 169-080-003 on the Assessor's tax rolls, until clearance is obtained from the Public Works Department. 1 hereby certify that this is a true and correct copy of an action taken and entered on the minutes of the Board of Supervisors on the d 'own.
