HomeMy WebLinkAboutMINUTES - 04041989 - T.2 TA THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on April 4, 1989 by the following vote: AYES: Supervisors Fanden, Schroder,McPeak and Torlakson NOES: None ABSENT: Supervisor Powers ABSTAIN: None --------------------------------------------------------------------- SUBJECT: Hearing On General Plan Amendment 3-87-CO, Rezoning Application 2795-RZ, Development Plan 3011-88 and Subdivision 7110, Smith/Perma Bilt and Barrett Irvine, Walnut Creek Area. On March 28, 1989, the Board of Supervisors continued to this date the hearing on the recommendation of the Contra Costa County Planning Commission on a request by Smith/Perma Bilt (applicant) and Barrett Irvine (owner) to amend the County General Plan for 207 acres of land from Agricultural Preserve to Single Family Residential Low Density and Open Space ( 3-87-CO) and for an associated development project which would allow for 219 units; and to consider the Planning Commission recommendation on applications 2795-RZ, Development Plan 3011-88, and Subdivision 7110 for the proposed project in conjunction with the General Plan amendment in the Walnut Creek area. Karl Wandry, Community Development Department, presented a staff report, commenting on the applicant' s revised plan, and requested that the Board approve a modified General Plan Amendment to reflect the modified plan, approve the environmental documentation as adequate for the approval of the project, approve the rezoning request, the final development plan, and the subdivision map and adopt the findings that the Board will have after the hearing today and staff will bring back to the Board. He requested that the Board declare intent to approve and direct the staff to bring the findings and modified conditions back to the Board next Tuesday for final approval. The following persons appeared to speak: Terry Camp, 2890 North Main, Walnut Creek, spoke in favor of the proposed project. Steve Stalker, 2110 Angus Drive, Walnut Creek, representing Walnut Acres Day Care, spoke on day care requirement. Genevieve Sattler, 4050 Poplar Avenue, Concord, spoke in opposition to the proposed project. Phyllis Roff, 2893 San Carlo Drive, Walnut Creek, spoke in support of the proposal. Joseph L. Campbell, 3215 Caravelle Court, Walnut Creek, spoke in favor of the project. JoAnn Hanna, Walnut Creek, representing the Open Space Foundation, spoke on inconsistency and inadequacy of the General Plan, and she submitted written information for Board consideration. Jean Siri, 1015 Teneve Place, El Cerrito, representing the West Contra Costa County Conservation League, spoke on the need for affordable housing and urged the Board to make this a good project. The Chair read into the record a card and letter from Joseph Devito, 3180 Oak Grove Road, Walnut Creek, relative to condition #23 . The Chair read into the record a comment from Joyce Payne, no address given, in opposition. Gail A. Landis, 851 North Gate Road, Walnut Creek, spoke in opposition. Steve Roberti, 525 Green Street, Martinez, representing the Central Labor Council, spoke in support of the proposed project. Brenda Neal, 3140 Hambletonian, Walnut Creek, spoke in opposition to the proposed project. John Compaglia, 3370 Worth Court, Walnut Creek, spoke in favor of the proposed project. Supervisor Torlakson requested clarification on the drainage and the existing ponds. Mr. Wandry responded on the need for collect and convey, and on condition 423 and the Cox and Devito properties. John Wyro, 1393 N. California #500, Walnut Creek, representing Smith/Perma Bilt Development, spoke in rebuttal. Supervisor Torlakson requested clarification on the traffic impacts of the proposed project. Mr. Wyro responded to Supervisor Torlakson' s request. Mr. Devito requested clarification on the letter he had presented to the Board today. Mr. Wandry and Mr. Wyro responded to Mr. DeVito' s request. Mr. DeVito commented on his concerns relative to his pond. Supervisor McPeak requested another condition that would require review on the parcel of the most effective, drought-resistant landscaping and water conservation reclamation. The public hearing was closed. Supervisor Schroder commented on the. negotiations on various issues with the City of Walnut Creek and various groups relative to this proposal and he recommended an intention to amend the General Plan and approve the Development Plan with conditions that have been worked out. Supervisor Schroder commented on various conditions to be on the proposal including the fee benefit area and fees, park land dedication fees, and child care fees. Supervisor McPeak commented on the child care fee requirements. Supervisor Schroder further commented on issues including reduction of units for the project to 205, the sidewalks on the loop road only, designation of the agricultural use of contiguous properties, and the homeless fund. Supervisor McPeak commented on a proposed contribution by the developer to the homeless fund. Supervisor Schroder further commented on the dedication to open space. Supervisor McPeak requested clarification on the issue of the amount of the total park and open space dedication fees, and the timing of the collection of those fees to begin construction of Arbolado Park. Mr. Wandry responded to Supervisor McPeak' s request. Supervisor Schroder moved the intent to amend the General Plan, approve the development plan along the conditions that the Board outlined here. Supervisor Fanden seconded the motion and requested clarification on the issue of the voluntary contribution for the homeless fund. The Board discussed the issue of the voluntary contribution to the homeless fund. Supervisor Schroder requested clarification from County Counsel on the issue of being in violation of State law if the General Plan Amendment is approved. Victor Westman, County Counsel, responded to Supervisor Schroder' s request. Supervisor Torlakson expressed support for the motion. IT IS BY THE BOARD ORDERED that the Board of Supervisors DECLARES ITS INTENT to approve General Plan Amendment request 3-87-CO, Rezoning Application 2795-RZ, Development Plan 3011-88 , and Subdivision 7110 with amended conditions; and the Community Development Department is DIRECTED to prepare appropriate documentation for Board consideration on April 11, 1989 Determination calendar; and Ordinance No. 89-21 is INTRODUCED, reading waived and April 11, 1989 is set for adoption of same. i trereby certify that this is a true and correct copy of an action taken and entered on the minutes of the Board of Su ora on a date shown.
