THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA T. 5 Adopted this order on April 25, 1989 by the following vote: AYES: Supervisors Powers, Fanden, Schroder, McPeak and Torlakson NOES: None ABSENT: None ABSTAIN: None --------------------------------------------------------------------- --------------------------------------------------------------------- SUBJECT: Hearing On Rezoning Application 2817-RZ, Development Plan 3036-88,and Subdivision 7153, C.L. Associates and Harry and Dennis Populis, et al, Martinez. This being the time heretofore noticed by the Clerk of the Board of Supervisors for hearing on the recommendation of the Contra Costa County Planning Commission on the request by C.L. Associates (applicant) and Harry and Dennis Populis, Edgar and Donna Irwin and James and Wilma Choate (owners) to rezone 3 . 67+ acres of land from Single Family Residential District (R-10) to Planned Unit District (P-1) and for preliminary development plan approval (2817-RZ) , and for approval of Final Development Plan for 17 residential lots (3036-88) and for approval for Tentative Subdivision Map 7153 to divide the 3. 67+ acres into 17 lots in the Martinez area. Mary Fleming, Community Development Department, presented the staff report, on the project, described the proposed project site, and advised that a Negative Declaration had been done for this project. She commented that the project is compatible with the General Plan of the City of Martinez. She commented on the Planning Commission' s approval for 16 lots eliminating lot number 9. Ms. Fleming advised that the staff recommendation is to approve the rezoning application, development plan and the tentative map, to adopt the Planning Commission' s findings, accept the environmental review documentation as being adequate and introduce the ordinance giving effect to the rezoning. The public hearing was opened and the following people appeared to speak: Robert M. Duchi, 1911 San Miguel Drive #203, Walnut Creek, DK Associates, the applicant, commented on the reasons for the elimination of lot number 9, the appropriateness of the subdivision for the area, and the compatibility with the City of Martinez. Jerry Landes, 4956 Milano Way, Martinez, commented on concerns including scenic impact from the proposed embankment, the size of the proposed lots, and drainage problems, and requested that the developer work out a drainage and sewer system with the property owners.. Kate Olsen, 4960 Milano Way, Martinez, commented on concerns including drainage and aesthetics, and expressed a willingness to work with the developer about easements if he is willing to consider the option the homeowners feel would improve the drainage and aesthetics. Robert K. March, 1945 Hopkins Street, Berkeley, commented on concerns including sewer and storm drainage, and spoke in opposition to the earth moving which will create instabilities around the land. Mr. Duchi spoke in rebuttal commenting on the issues including drainage, sewerage, and the embankment. The public hearing was closed. Supervisor Fanden recommended that Flood Control meet with the interested parties and the representatives of the company and return to the Board with a solution on the issues raised today. 1. On recommendation of Supervisor Fanden, IT IS BY THE BOARD ORDERED that the decision on rezoning application 2817-RZ, Development Plan 3036-88 and Subdivision 7153 is DEFERRED to May 9, 1989; and Flood Control staff is DIRECTED to meet with interested parties and representatives of C.L. Associates to address issues of drainage and aesthetics raised during today' s hearing with a report to the Board of Supervisors on May 9, 1989.
