Resolution of the Board of Supervisors of Contra Costa County approving the
application to the local grant program under the EBRPD Regional Open Space,
Wildlife, Shoreline, and Parks Bond Ordinance Phase I for the following
project(s) :
Ed Cornell Park Crockett Park
Hap Magee Park Crockett Community Center
Marie Porter Park Lone Tree Point
Park Land Acquisition Montarabay Park Land Acquisition Oakley
WHEREAS, the voters of Alameda and Contra Costa Counties have authorized the
issuance of the Regional Open Space, Wildlife, Shoreline, and Park Bond
Ordinance, which provides funds to the East Bay Regional Park District for
acquiring and/or developing facilities for public recreational and open space
purposes; and
WHEREAS, the East Bay Regional Park District has the responsibility for the
administration of the Local Grant Program within the two counties, setting up
necessary procedures governing application by local agencies under the program;
and
WHEREAS, said procedures established by the East Bay Regional Park District
require the applicant to certify by resolution the approval of applications
before submission of said applications to the district; and
WHEREAS, said applications contain assurances that the applicant must comply
with; and
WHEREAS, the applicant will enter into an agreement with the East Bay Regional
Park District for acquisition or development of the projects;
NOW, THEREFORE, BE IT RESOLVED that the Contra Costa County Board of Supervisors
hereby:
1. Approves the filing of an application for the Local Grant Program under the
Regional Open Space, Wildlife, Shoreline, and Parks bond Ordinance for the
above project(s) ; and
2. Certifies that said agency understands the assurances and certification in
the application form; and
3. Certifies that said agency shall perform all acts and obligations of the
agency under the application and the instruments and documents delivered
pursuant thereto.
4. Certifies that said agency has or will have sufficient funds to operate and
maintain the project(s) ; and
5. Certifies that said agency shall use the funds from the Local Grant Program
to acquire and develop the project in accordance with the application; and
6. Certifies that said agency reasonably expects to complete the project(s)
within three years from the agreement date; and
7. Appoints the Director of Community Development as agent of the Contra Costa
County to conduct all negotiations, execute and submit all documents
including, but not limited to applications, agreements, amendments, payment
requests and so on,- which may be necessary for the completion of the
aforementioned projects in such form and pursuant to such provisions as
EBRPD and this agency shall agree.

1. The grant applicant hereby gives assurance and certifies with respect to
the grant that:
It possesses legal authority to apply for the grant, and to finance, acquire
and construct the proposed project; that a resolution, motion or similar
action has been duly adopted as an official act of the applicant's governing
body, authorizing the filing of the application, including all understandings
and assurances contained therein, and directing and authorizing the person
identified as the official representative of the applicant to act in
connection with the application and to provide such additional information as
may be required.
2. It understands that General Obligation Bonds must be sold by the EBRPD
before agreements can be signed by the EBRPD and before costs can be incurred
by the applicant against the grant.
3. It will cause work on the project to be completed within three years of
the date of receipt of bond funds by EBRPD which will be the same date the
EBRPD General Manager signs the agreement. It also agrees to make any
development project open to public use by the DATE SPECIFIED IN THE AGREEMENT
WHICH VILL NOT BE MORE THAN THREE YEARS AFTER THE DATE BOND FUNDS ARE RECEIVED
AND THE AGREEMENT SIGNED BY THE GENERAL MANAGER.
4. It will provide and maintain competent and adequate architectural and/or
l` engineering supervision and inspection at the construction site to insure that
the completed work conforms with the plans and specifications; that it will
furnish progress reports and such other information as the EBRPD may require.
S. It will give the EBRPD's authorized representative access to and the right
to examine the project site and all records, books, papers or documents
related to the grant.
6. It will not dispose of or encumber its title or other interests in the
site and facilities.
7. For each individual project, it will submit appropriate California
Environmental Quality Act documents, a project information form, cost
estimates for development projects, an acquisition schedule for acquisition
projects, site and location maps. (This information must be submitted before
grant funds are disbursed.)

ASSURANCES
1. The grant applicant hereby gives assurance and certifies with respect to
the grant that:
It possesses legal authority to apply for the grant, and to finance, acquire
and construct the proposed project; that a resolution, motion or similar
action has been duly adopted as an official act of the applicant's governing
body, authorizing the filing of the application, including all understandings
and assurances contained therein, and directing and authorizing the person
identified as the official representative of the applicant to act in
connection with the application and to provide such additional information as
may be required.
2. . It understands that General Obligation Bonds must be sold by the EBRPD
before agreements can be signed by the EBRPD and before costs can be incurred
by the applicant against the grant.
3. It will cause work on the project to be completed within three years of
the date of receipt of bond funds by EBRPD which will be the same date the
EBRPD General Manager signs the agreement. It also agrees to make any
development project open to public use by the DATE SPECIFIED IN THE AGREEMENT
WHICH WILL NOT BE MORE THAN THREE YEARS AFTER THE DATE BOND FUNDS ARE RECEIVED
AND THE AGREEMENT SIGNED BY THE GENERAL MANAGER.
4. It will provide and maintain competent and adequate architectural and/or
engineering supervision and inspection at the construction site to insure that
the completed work conforms with the plans and specifications; that it will
furnish progress reports and such other information as the EBRPD may require.
S. It will give the EBRPD's authorized representative access to and the right
to examine the project site and all records, books, papers or documents
related to the grant.
6. It will not dispose of or encumber its title or other interests in the
site and facilities.
7. For each individual project, it will submit appropriate California
Environmental Quality Act documents, a project information form, cost
estimates for development projects, an acquisition schedule for acquisition
projects, site and location maps. (This information must be submitted before
grant funds are disbursed.)
8. In cases involving leased property, it agrees to maintain and operate the
property and/or facilities acquired or developed for an agreed to period
commensurate with the type of project and proportion of General Obligation
Bond funds and local funds allocated to the capital .costs of the project.

SUBJECT: East Bay Regional Park District Measure AA Funds
The Board this date adopted Resolution No. 89/274
authorizing submission of an application to the local grant program
under the East Bay Regional Park District (EBRPD) Wildlife,
Shoreline and Parks Bond Ordinance Phase I (Measure AA) for certain
projects approved by County Services Areas, as listed in the
attached report from the Community Development Department.
During the discussion on the grant program it was
brought to the Board' s attention that the EBRPD process for
allocation of funds generated in the unincorporated areas that are
without local park agencies would most likely begin in late 1991,
and that the required hearings would be conducted by the park
district or city that will utilize the funds to serve the
unincorporated areas. Board members agreed on the need for County
involvement in the allocation of such funds and the need to
establish dialogue with EBRPD to assure County input in the
allocation process.
Therefore, IT IS BY THE BOARD ORDERED that the issue of
allocation of Measure AA funds in the unincorporated areas is
REFERRED to the Internal Operations Committee.

RECOMMENDATIONS
Approve the project . list and adopt the attached resolution for
submittal to the East Bay Regional Park District. The resolution
must reach EBRPD by May 1, 1989 to receive funds in the first
round.
BACKGROUND/REASONS FOR RECOMMENDATIONS
Measure AA which was sponsored by the East Bay Regional Park
District passed in November 1988. This Bond Measure provides funds
to County Service Areas for park and recreation projects. These
funds can be made available in 1989 or 1990 depending on the
readiness of the local agency.
Eight County Service areas have been meeting to determine their
recommendations to the Board of Supervisors. The amounts to be
received all projects selected are summarized below.

In 1992 the second series of bonds will be sold and the remaining
service areas must have their projects ready to go.
In addition, the East Bay Regional Park District must allocate
$1, 448,304 in funds generated in the unincorporated areas that are
without local park agencies. The EBRPD process requires that
hearingbs be held to receive comments from the affected areas. The
hearings are to be conducted by the nearby park agency or city that
will utilize the funds to serve the unincorporated areas. This
process will likely begin in late 1991.
