HomeMy WebLinkAboutMINUTES - 04251989 - 1.4 (2) 1-7040 gE Y TO: Board of Supervisors FROM: Phil Batchelor, County Administrator DATE: April 17, 1989 STa------ SUBJECT: LEGISLATION: AB 298 (Peace) Specific Request(s) or Recommendations(s) & Background & Justification RECOMMENDATION Adopt a position in SUPPORT of AB 298 by Assemblyman Peace which would specifically authorize the State Controller, to the extent funds are available, to reimburse counties for their costs in removing and disposing of hazardous waste resulting from a release on public or private property, the source of which was a laboratory used for the unlawful manufacture of a controlled substance. BACKGROUND: Under current law fines collected under various provisions concerning the use of specified substances which may be used in the manufacture of controlled substances are forwarded to the State. This fine revenue is then used to reimburse counties for costs incurred in removing and disposing of,or storing,toxic wastes from the site of an illegal drug laboratory. The money can also be used to assist state and local law enforcement and prosecutorial agencies in apprehending and prosecuting persons involved in the unlawful manufacture of controlled substances. Assemblyman Steve Peace has introduced AB 298 which expands the costs which can be reimbursed under these provisions to include the costs of a hazardous waste release on public or private property, the source of which was a laboratory used for the unlawful manufacture of a controlled substance. The Health Services Director reports that in the 1988-89 fiscal year the Health Services Department has already responded to 26 calls regarding drug laboratories. The Department has spent a total of$4800 this fiscal year in responding to such incidents. Passage of AB 298 would allow the Health Services Department to attempt to recover its costs for responding to these incidents. The Health Services Director supports AB 298 and urges the Board to also support this legislation. This office concurs with that recommendation.
