BACKGROUND Supervisor Robert I. Schroder advised the Board that he had received a letter from William H. Monsen relative to requesting that restrictions be established on working hours of subdivision development. He noted that the correspondent referred to subdivision activity beginning as early as 5 A.M. on week days and weekends. RECEIVED 415-920-5718 April 1, 1989 APR 31989 The Honorable Robert Schroeder Supervisor, District SUPT(''r ov' SCHRODER Contra Costa County 510 La Gonda Way Danville, CA 94526 Dear Supervisor Schroeder; As I . sit here at b AM on Saturday, I am writing you in hopes that you will be able to find a way that my family and our neighbors can get a little relief from the subdivision activity that is going on at shadow Creed:: on Camino Tassaiara. We purchased our home in Bl ack:hawk: with the full k:nowl edge and understanding that a subdivision was proposed behind us. Starting a year ago, the grading began and we had to listen to the equipment starting work: at from anywhere between 5 AM to sometimes as late as 6: 30 and continuing on until , in one instance 10: 10 PM. This included Saturdays, Sundays and holidays and went on during the grading, underground, utilities, curb and gutter- and paving. The contractors worked seven days a weed:: including holidays, not necessarily all day but usually starting at daybreak: or before. I think that the earliest that I recall was Q ZO AM. I called the County Public Works Department to complain and was told that the County had no control over the working hours of subdivision contractors, but that they would appeal to the comtractor-s and the developer- to restrict the working nq_ hours. This accomplished nothing. The houses are now under construction. I hear the work:er-s start between 5: 10 to 6: 10 AM. The first thing that theydo is to start up the materials handling equipment. Yesterday they started at 5: 15 AMI but were finished at 2: .00 RM and having their Friday afternoon beer bust. Weekdays are not the problem. What is infuriating is the fact that the early start-up continue=_ every weekend and holiday. As you may have determined, I am deeply annoyed by this. I respect my home and my neighbors and try not to interfere with their personal lives. Dame Construction apparently has no such respect, and the County informs me that there is no control over the working hours of the contractors. What then are we able to do to at least have some peace and quiet on the weekends. Blackhawk restricts the contractors from entering the community until 9:00 AM on weekends. •�il.' r .F The Honorable Robert Schroeder Page I am ask::i ng that you try and help future nei gnbors of subivision development by establishing some restrictions on the working hours of the contractors at the Tentative Map stage, in the Subdivision Agreement, or as a condition of Building Permits. I do not think:: that this is unreasonable and that it should be enforceable. I apologize for the rambling letter, but as you can probably . tell , I am very upset and frustrated as are my neighbors.
