SUBJECT: REPORT ON COUNTY'S DISPUTE RESOLUTION PROGRAM

RECOMMENDATION:
1. Accept Report from the Dispute Resolution Advisory Committee, dated April 5,
1989, on the County's Dispute Resolution Program and consider adoption of funding
recommendation as follows:

the County the contract required to implement the following approved Dispute

FINANCIAL IMPACT:
The Dispute Resolution Program is fully revenue offset by funds generated from a three
dollar filing fee on civil actions in the Superior and Municipal Courts. No County
general funds are involved.
REASONS FOR RECOHMENDATION/BACKGROUND:
The Dispute Resolution Programs Act of 1986 (Business and Professional Code Sections
465, et seq. ) provides for the establishment and funding, at County option, of local
dispute resolution services as an alternative to formal court proceedings. The Act
authorizes participating counties to increase Superior, Municipal and Justice Courts
filing fees from one to three dollars for the purpose of funding the local dispute
resolution programs.
On January 1, 1987 the Contra Costa County Board of Supervisors approved the County's
participation in the program and authorized a three dollar increase in court filing
fees. The Dispute Resolution Advisory Committee was formed to consider implementation
strategies and funding guidelines appropriate for Contra Costa County.

The Advisory Committee has solicited proposals for funding under the Dispute
Resolution Programs Act of 1986. The purpose of the funding is to encourage the
establishment and use of local dispute resolution services as an alternative to formal
court proceedings. The program operates under the provisions of the Dispute
Resolution Programs Act Proposed Funding and Operating Regulations issued October 12,
1988, which requirements along with the Act itself were incorporated into the Request
For Proposals (RFP).
In August 1988, the Dispute Resolution Advisory Committee established program funding
priorities and set a 1988-89 (first round) funding limit at $100,000. The designated
funding priorities were incorporated into the Dispute Resolution Program RFP which was
issued in January of 1989 with a submission deadline of February 10, 1989. The RFP
focused on: Potential for first year impact, cooperative efforts of community
organizations, demonstrated linkages to justice agencies, and emphasis on domestic
violence and human relations. A schedule was developed which allowed for a series of
meetings to give proposer the opportunity for development of a cooperative proposal.
On February 10, 1989 the Criminal Justice Agency received three responses to the RFP
from the following agencies: California Community Dispute Services, Conflict
Resolution Panels of Contra Costa County, and the Contra Costa County Human Relations
Commission. Each application was evaluated for conformance to the State's proposed
regulations and the County's own application requirements.
On March 30, 1989 the Advisory Committee convened to consider the three proposals.
Presentations were heard from each of the three organizations. The following is a
brief summary of each proposal:
1) CCDS requested $47,195 for the West Contra Costa County Community Dispute
Services. This proposal met all state and County requirements of the RFP. The
proposed program is to operate under the guidance of the West Contra Costa County
CDS Advisory Council. This group already is established with members from the
City of San Pablo, Contra Costa County Supervisor Fanden's Office, Assemblyman
Campbell's Office, Pinole Chamber of Commerce, Contra Costa County District
Attorney's Office, CCDS Volunteer Liaison Committee, Easter Hill United
Methodist Church, Contra Costa County Supervisor Power's Office, and Contra Costa
County Public Defender's Office. The program has been in development in West
Contra Costa County for over two years trains its own volunteers. The program
has strong ties to the justice system, receiving referrals from the Municipal
Courts., the District Attorney's Office, Police Departments, Small Claims Courts,
and the Juvenile Justice System.
2) CRP of CCC requested $389,040 for the Dispute Resolution Program. This proposal
exceeded the established funding limit and did not conform to other state and
County requirements of the RFP. The Panel is affiliated with California
Association of Community-Based Mediation/Conciliation Programs, local courts,
churches, NAACP, Urban League and other civic organizations.
3) CCC HRC requested $119,500 for Contra Costa County Dispute Resolution Services.
This proposal did not meet all the state and local requirements of the RFP. This
project is designed to promote cooperation among conflict resolution projects in
Contra Costa County. This project is a network which consists of the Contra
Costa County Human Relations Commission, Battered Women's Alternatives, Catholic
Charities, Housing Alliance, and the Housing Authority and is consistent with the
cooperative focus of the RFP.
The Advisory Committee held a public hearing during their meeting. Staff reported on
each proposal and recommended that California Community Dispute Services be funded.
The Advisory Committee adopted this funding recommendation and also agreed to table
proposals from Conflict Resolution Panels of Contra Costa County and the Contra Costa
County Human Relations Commission until the next meeting in approximately one month.
Staff have reviewed the Report of the County Dispute Resolution Advisory Committee,
dated April 5, 1989, detailing its recommendations to your Board for funding and
support the recommendations of the Advisory Committee.
