On March 21, 1989, the Board of Supervisors and Redevelopment Agency of Contra, Costa County continued to this date the joint hearing between the Contra Costa County Board of Supervisors and the Contra Costa County Redevelopment Agency to consider a Disposition and Development Agreement (DDA) between the Contra Costa County Redevelopment Agency and Pleasant Hill Development, a California Limited Partnership whose general partner is Urban Holdings, Inc. , providing for the development of an 882 unit rental housing project in the Pleasant Hill BART Redevelopment Project area. Jim Kennedy, Redevelopment Director, presented the staff recommendation for approval of the Disposition and Development Agreement as before the Board. He also commented on the purpose of the Disposition and Development Agreement. The publictlhearing was opened and the following person appeared to speak: James M. Berg, representing Urban Projects, spoke on the process involved in reaching agreement on the document under consideration today. He referred to a remaining unresolved financial issue and proposed language in the resolution to allow this to be addressed. He commented on the need to review the agreement in greater detail since it had not been ,;presented to him until today. However, Mr. Berg advised that he 'would request the Board to approve the form of the Disposition and Development Agreement conditioned upon the ability to negotiate any remaining terms to ensure consistency with the basic business deal relative to approval of the project. Supervisor ','McPeak requested clarification on what was before the Board in the resolution today, and what the positions of staff and the Pleasant Hill Development were on the matter. Mr. Berg and Mr. Kennedy responded to Supervisor McPeak's request. The public 'hearing was closed. Supervisor �GMcPeak moved to approve the resolution approving the Disposition and"Development Agreement given the flexibility to negotiate to resolve the one outstanding matter. RA 89-5 SUBJECT: Approval of a DDA between the Redevelopment Agency and Pleasant Hill Development, a California Limited Partnership, Pleasant Hill BART Station Area Redevelopment Project. It is the intent of the Redevelopment Agency to enter into a Disposition and Development Agreement (DDA) with Pleasant Hill Development, a California Limited Partnership, as the designated developer of Specific Plan Development Area 3 (and a portion of Area lA and 4) in the Pleasant Hill BART Station Area Redevelop- ment Project. The purpose of the DDA is to provide for: 1. Assistance by the Redevelopment Agency in the assemblage of the development site by a) providing for the assignment of the developers options on certain properties; and b) Agency acquisition by negotiated purchase or eminent domain properties which are not subject to developer options. 2. The conveyance of properties purchased by the Agency to the developer. 3. The orderly' relocation of all businesses, and' occupants as legally required. 4. The orderly development of Area 3 (and a portion of Area lA and 4) in accordance with the Redevelopment Plan. 5. Financial assistance by the Redevelopment Agency in order to assure development of the project with the housing affordability requirements of State Redevelopment law and Agency policy. The DDA has been made available for public inspection; and the Agency and Board of Supervisors have held a duly noticed public hearing to consider the DDA. The Redevelopment Agency and the Board of Supervisors finds that the DDA is in the best interest of the County and the Agency, and is necessary for implementation of the Pleasant Hill BART Station Area Redevelopment Plan. Therefore, the Redevelopment Agency RESOLVES: 1. That certain Disposition and Development Agreement between the Agency and Pleasant Hill Development, a California Limited. Partnership, on file with the Clerk of the Board of Supervisors affecting Specific Plan Development Area 3 (and a portion of Area lA and 4) in the Pleasant Hill BART Station Area Development Project, is hereby approved in substantially the form presented. RESOLUTION NO. RA 89-5 d 4.. 2.
