Caunty SUBJECT: Closure Cost Review at Acme Landfill SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION Authorize Chair to execute an Amendment to the transfer station rate regulation Consulting Services Agreement with Touche-Ross to include a closure and post-closure cost review of Acme Landfill. FINANCIAL IMPACT The cost for the Transfer Station Rate Regulation' s Program authorized by the Board is $55 ,640 (reduced from the original contract) . The additional cost for review of closure cost is, $74, 508 . The amended contract increases the payment limit to be the sum of these two costs, $130, 148. This cost will be recovered from the Acme Fill Corporation. Acme' s cost for both these projects will be considered an eligible expense to be incorporated into the rates at the landfill and transfer station. REASONS FOR RECONIlMENIDATION/BACKGROUND On March 21, 1989 the Board of Supervisors approved a contract with Touche-Ross to establish a rate review program which requires approval of disposal rates by the County for fees charged at the Acme Interim and Permanent Transfer Station. The Board also authorized staff to negotiate an agreement with Touche-Ross to review the closure and post-closure costs at Acme Fill. Closure and post-closure costs are expected to be assessed at the Acme Transfer Station. Staff has negotiated an amendment to the agreement with Touche-Ross to conduct the closure cost review. Touche-Ross has subcontracted with the firm of Brown and Caldwell, of Pleasant Hill, to provide them technical assistance to review the ad1equacy of the closure plans and cost estimates. Touche-Ross and Brown and Caldwell are qualified to do the closure cost study. Summarize landfill closure regulations of the different governmental agencies. - Review reasonableness of' closure and post-closure plans and costs , including recapture periods. - Identity costs that should have been provided for, changes in cost due 'to changes in regulation, and cost changes due to price fluctuations. Recommend policies for recording, reporting and managing projected and actual closure cost. Identify who should pay for closure. A preliminary draft of the Closure Report will be prepared within one month ( approximately May 9, 1989) . The final Closure Report is expected to be completed within two months ( approximately June 6, 1989) . A preliminary report on the rate regulation of the transfer station will be completed within two months ( approximately June 6 , 1989) . The rate regulation procedures will be established one month later (approximately July 4, 1989) . The determination of a rate will be finished one month after Acme completes the rate application (about August 1989) . Staff will- provide regular updates to the Board on the status of both studies. -2-
