EXECUTIVE SUMMARY
A. INTRODUCTION:
This report is subdivided into three major sections: 1) Executive Summary,
2) Detailed Schedule and Financial Information and 3) Attachments. it
describes the design and construction progress as well as Areas of Concern
for the West County Justice Center, Marsh Creek Detention Facility and
Martinez Detention Facility achieved during the period of November 1988.
B. GENERAL:
1. West County Justice Center
a. Community Participation
There have been no recent meetings of the West County Justice Center
Advisory Group. The next meeting of the Advisory Group is scheduled
for December 7. The Employment and Training Committee met on
October 19 to review progress with the County's developing MBE/WBE
program.
b. Site Acquisition
The County's consulting attorney estimates that the condemnation
trial will occur some time between late March and early May. The
mandatory settlement conference is likely to occur in late January.
Supplemental appraisal. data will be available prior to the
settlement conference.

2. Harsh Creek Detention Facility
♦ Wastewater Treatment Facility
The construction contractor has directed his efforts to replacement
and upgrading of the existing sewer main, work that will allow
operational changes required to maintain the existing failing system
throughout the wet winter months.
C. SCHEDULE:
1. West County Justice Center
a. Design:
The furnishing, equipment and signage preliminary design
presentation was made on November 2. Work remains on schedule.
Following is the remaining design schedule:

b. Construction:
1) Contract A: Substantially complete.
2) Contract B: Construction contract critical activities were
underslab electrical and communications conduit, foundation
footing construction, erection of the first two courses of
concrete block, and slab-on-grade for the Administration
Building. Schedule status was as follows:

Recommendation of a 4 calendar day extension will be made for
Claim Number One. Detailed information is contained in

2. Marsh Creek Detention Facility
a. Design
♦ Wastewater Treatment Facility
John Carollo Engineers issued a revised sanitary sewer line plan.
The design incorporated the new dorms, whereby the sewage from the
new dorms can flow either to the east or the west leach field.
Additional ongoing design services include an interim sewer
treatment system expanded and fire service line.
♦ Modular Dormitories
Both the Board of Corrections and the County's Building Inspection
Department approved the design. Approval from the local fire
district is pending receipt of the revised fire sprinkler plans and
is expected before the end of the month.
b. Construction
♦ Wastewater Treatment Facility
Contractor remobilized on October 31 with a reduced scope of work
consisting of reconstruction and expansion of the gravity sewer
line, grading and paving, fire service line and limited other items
for a complete and usable sanitary sewer infrastructure. Project
completion is scheduled for 1/15/89.

♦ Modular Dormitories
1. Site Work: Site grading (cut to fill operation) continued.
This phase of work was delayed by the installation of a
subsurface drain required by the soils engineer and by the
excess time taken to remobilize grading crews after each rain.
This phase of work is currently 30 days behind the contractor's
schedule.
2. Modular Fabrication: Approximately 100% of the factory work is
complete. This phase of work is on schedule, however, Milestone
III, the installation of mods onto foundation, has slipped 11
days since the site work is delayed.
3. Martinez Detention Facility
a. Design
The Architectural Services Agreement for the Contract Documents,
Bidding and Construction Phases of the project was approved by the
Board of Supervisors on November 29.

E. MAJOR AREAS OF CONCERN:
1. West County Justice Center:
♦ Contract A: Oliver de Silva, Inc.
a. Storm Drain in the Park:
Problem: The storm drain in the park was extended, but the
outlet of the pipe is lower than adjacent grades and causes
ponding.
Action: The Civil Engineer proposed cutting a V-ditch from the
outlet, directing flow around the edge of a loop road in the
Park. The Park objected and requested the County to contact the
Southern Pacific Railroad to obtain permission to cut a ditch in
the Southern Pacific property. The CM has contacted SP.
b. Street Light Photocells:
Problem: Four (4) street lights installed along Giant Highway do
not automatically turn-off because photocells have not been
provided. The Contractor contended that the contract design does
not indicate the circuiting for the type of photocells specified.
Action: The Contractor has been directed to install the
photocells.

Contract B: Walsh Construction Company
a. Plumbing & Structural Conflicts (Claim One):
Problem: Contractor claimed 24 days and $59,000 due to alleged
conflicts between the underground plumbing and structural
footings.
Action: Claim review/negotiation meetings continued. On
11/04/88, the Construction Manager countered the Contractor's
proposal of $40,585 and offered a settlement of $25,000 and four
day's time extension. The offer was accepted and CM is preparing
the change order recommendation. _
b. Progress Schedule Slippage:
Problem: Per the Contractor's 11/25/88 CPM schedule update, the
Contractor is 14 calendar days behind schedule.
Action: The CM and Contractor have developed work around
solutions to expedite the work by making concrete block
activities concurrent rather than sequential with slab concrete
work. It is forecasted that the Contractor may regain lost time
by expediting the block work. In addition, a four (4) day
contract time extension is recommended for Claim No. One
discussed above.
C. CPM Schedule:
Problem: The initial CPM schedule was rejected due to
questionable activity durations, crew loading, cost loading and
logic.
Action: The Contractor is to revise and resubmit the schedule.
Only the revised cost loading has been submitted.
d. Quarry Waste:
Problem: The Architect was concerned that the quarry waste
located around the outer and inner perimeter security fences
would gradually erode when placed on the slopes.
Action: To mitigate this potential problem, the quarry waste can
be replaced with gravel as recommended by the Architect (cost
$20,000) or the quarry waste can be coated with a liquid asphalt
material as recommended by the CM (cost $3,000). Based on cost
considerations, the CM's recommended action was accepted by the
County.

Contract B: Walsh Construction Company(Cont'd)
e. Electrical Room Equipment Clearances:
Problem: County code inspector stated the Contractor's layout
for electrical equipment will not meet code clearance
requirements. The Contractor is claiming foundation demolition
cost and a delay stating that the room size as originally
designed was too small.
Action: The CM, AE and electrical subcontractor completed the
reconfiguration of the electrical equipment layout to meet the
code requirement. CM has rejected the Contractor's claim since
the Contractor had two obligations: (1) to meet the technical
requirements for the electrical equipment and (2) to select
electrical equipment that fits within the prescribed space.
f. Fire Riser Room:
Problem: The Contractor alleges that the fire riser equipment,
as designed, will not fit in the allotted space without
reconfiguration and claims extra costs for relocation of
equipment.
Action: The CM has rejected the claim because the specifications
require the Contractor to design and build the fire protection
system.
g. Precast Lintel Delay:
Problem: The Contractor alleged the AE delayed the submittal
review of the precast lintel.
Action: The CM rejected the claim due to lack of schedule
substantiation from the Contractor. The Contractor rescinded the
claim when the submittal review was resolved.
h. Cell Door Locks:
Problem: The program requires that mechanical override be
provided for cell doors, however, the contract documents specify
a lock but no cylinder. In November, AE proposed adding a
cylinder and a cylinder extension to the lock to provide a
mechanical override for each of the affected 480 cell doors.
Action: CM has instructed the contractor to price the proposed
change.
i. Letter of Credit:
Problem: Contractor has proposed a letter of credit as a
substitution for the retention from the monthly progress payment.
Action: County Counsel is reviewing the proposal.

j. Kitchen Equipment:
Problem: The Architect has put a hold on the review of the quick
chill equipment and food carts at the County's request while
alternatives are investigated.
Action: AE and County were requested to expedite their
decisions.
k. Floor Tile•
Problem: The County's Interior Designer is proposing to change
the floor tile.
Action: The Interior Designer was instructed to select colors
based on the original contract tile.
1. Crew Size:
Problem: The Contractor is not providing adequate crewing for
electrical, communication and block work.
Action: The Contractor has been put on notice that the original
planned crewing must be maintained.
m. Communication Multiplex Unit:
Problem: The Contractor claims the specified multiplex unit
cannot provide the specified performance.
Action: The Architect is reviewing the Contractor's claim.

2. Marsh Creek Detention Facility:
♦ Modular Dormitories
a. Grading:
Problem: Soils Engineer requires a subsurface drain to be
constructed in the keyway of the fill slope. The contractor
claims that the subsurface drain was not part of the design
therefore claims this work as an extra.
Action: Since this is a design-build contract, the CM agreed to
eliminate the requirement for a subdrain only if the contractor
provides certification from an independent geotechnical engineer
that the subdrain is not required. The contractor installed the
subdrain under protest and may file a claim,
b. Fire District Approval:
Problem: Design approval from the local fire district has not
been issued due to the uncertainty of available water pressure
and flow. The contractor is concerned that approval delays will
impact the sprinkler system fabrication schedule.
Action: The CM and the local fire district arranged additional
water pressure testing with the water district. The 11/17 test
revealed that the fire sprinkler plans do not match the fire
sprinkler calculations. The Contractor revised and submitted
calculations and plans which are pending fire district review.
C. Design Approval:
Problem: The County's Building Inspection Department issued one
building permit for each dorm on 11/4/88; however, the electrical
portion has not been approved.
Action: The CM directed the contractor to submit revised
electrical calculations and plans for the building department's
review.
d. Delayed Milestone:
Problem: The contract milestone 3 was scheduled for 11/14/88, at
which time all modules were to be set on building foundations.
The milestone completion has slipped 11 days to date.
Action: The CM reviewed the contractor's schedule and concluded
that concurrent delays have occurred. Negotiations have started
to revise the construction schedule, whereby putting all
assessment of interim liquidated damages on hold until
negotiations are complete. An initial schedule analysis suggests
that this delay can be made up during the remaining construction
period.

♦ Wastewater Treatment Facility
a. Work Stoppage:
Problem: The Court's decision stopping construction of the.
wastewater treatment facility pending compliance with the
California Environmental Quality Act requires on-going use of the
facility's failing leach field.
Action: The design engineer was directed to modify the design to
allow the existing system to be repaired and upgraded consistent
with the Court order. On October 31, the contractor was given
revised plans and specifications for modifying the existing sewer
main. The engineer continues to prepare additional plans for a
temporary septic tank and leach pit.

SCHEDULE ANALYSIS
1. GENERAL:
The detailed schedule report is subdivided by three projects: 1) West
County Justice Center, 2) Marsh Creek Detention Facility and 3) Martinez
Detention Facility. The three projects are further divided into the design
and construction phases. The design portion will include general design
data and a progress narrative. The construction section will be subdivided
by each contract and will provide contract data, a progress narrative, plus
a bar chart.
2. West County Justice Center
a. Design:
The furnishing, equipment and signage Preliminary Design phase
presentation was made on November 2. The .Design Development phase
presentation is scheduled for December 6, which was scheduled to avoid
a conflicting Sheriff's Department conference.
b. Construction:
The West County Justice Center project includes two contracts:
1) The first contract was for the rough grading of the project
site (Contract A), which is substantially complete.
2) The second is for the construction of the detention facility
(Contract B).

B. PROGRESS NARRATIVE
1. Building One (Administration Building): Underfooting electrical
conduit installation was close to 100% complete. Underslab electrical
and communication installation was about 90% complete at the west side
and 15% complete at the east side. Underground plumbing installation
was approximately 98% complete at the west side and 80% complete at
the east side. The first two courses of concrete blocks were 95%
complete at the west side but no progress at the east side.
Slab-on-grade installation was 80% complete at the west side with no
progress at the east side. According to the Contractor's November

CPM schedule update, the project critical path still goes through Building
No. 1. While a four (4) calendar day delay has been assessed against the
underground plumbing/structural conflicts, additional schedule slippage
observed for Building No. 1 (due to the Contractor's unsatisfactory
progress) in the last report period has not been improved. CM is reviewing
the schedule with the Contractor to assess how to regain the the lost time.
2. Building Two (Medical/Dental/Library/Classroom Building): Foundation
footing construction was complete. First two courses of masonry is 50%
complete. -
3. Building Three (Multi-purpose Building): No progress.
4. Building Four (Inmate Housing/Central Visiting): Slab-on-grade pours were
complete, except for south end where it connects to the tunnel. Exterior
concrete block wall first lift was 90% complete. Above ground plumbing
started.
5. Building Five (Inmate Housing): Slab-on-grade pours for the wings were
complete. Foundation footing construction was complete for the Core Area.
Exterior concrete block wall first lift was 20% complete.
6. Building Six. (Inmate Housing): Slab-on-grade pours for the wings were 50%
complete. Foundation footing construction was complete for the Core Area.
7. Building Seven (Inmate Housing): Slab-on-grade pours for the wings were
40% complete. Foundation footing construction was complete for the Core
Area.
8. Building Eight (Inmate Housing): Slab-on-grade pours for the wings were
complete. Foundation footing construction was complete for the Core Area.
Exterior concrete block wall first lift was 95% complete.
9. Site Utilities: Storm drain system was approximately 97% complete.
Sanitary sewer system was approximately 95% complete. Site water line was
approximately 96% complete and pass pressure test. No progress on site gas
line system. Site underground electrical installation was approximately
96% complete. Site underground communication conduit installation was
approximately 75% complete.
10. Site Work: Phase 1 security fence pole installation was 100% complete at
the north and west sides and 90% complete at the east side. Interior road
base was 50% complete. Construction of the first 2 bays of the parking lot
was about 30% complete. Placement of topsoil around the perimeter slopes
was 90% complete. Phase I irrigation system was 55% complete. Parking lot
irrigation system was 20% complete.

3. Marsh Creek Detention Facility
a. Design
♦ Modular Dormitories
Final approvals were forwarded by the following reviewers:
Board of Corrections October 31
Building Inspection Department November 4
(Building permit issued except for electrical service)
To date, the design has been approved by all reviewing agencies except the
local fire district. Both the local fire district and the water district
conducted a fire hydrant pressure test on November 17. Based on the test
results, the contractor was directed to revise the fire sprinkler plans and
calculation. Revised plans were received from the contractor on . November
22 and forwarded to the East Diablo Fire District for .review. The Fire
Marshal's review is expected to be complete by the end of November.
All site grading continues to receive full time monitoring by the County's
Consulting Geotechnical Engineer.
♦ Wastewater Treatment Facility
John Carollo Engineers issued revised plans on October 31 that include
design of a sewer lateral to the new dormitories as well as. a by-pass line.
The design engineer is continuing with the design of a temporary sewage
holding tank and fire service line. Both designs are expected to be
completed next month and have not affected the construction of the gravity
line.
b. Construction
Currently the Marsh Creek Detention Facility program includes two contracts
for the construction and installation of the modular dormitories and the
construction of the wastewater treatment facility. Reports for each
project follow:

B. PROGRESS NARRATIVE:
1. In-plant, all fifty-six (56) 12' x 40' steel modules and four (4) 12'
x 24' steel modules were 100% complete and ready for shipping. This
work includes all wood framing, windows, siding, plumbing, rough
electrical, HVAC duct work and interior finishes.

2. On-site, the contractor installed the subsurface drain. Grading of
cut-to-fill continues with approximately 807 complete to date. Both
the delays from the installation of the subsurface drain and the slow
remobilization of the grading subcontractor after rain has caused
construction to slip 4 weeks behind schedule. This work is on the
critical path and must be completed before foundations can be formed
and poured.

The initial schedule was voided following the Court ordered work stoppage.
B. PROGRESS NARRATIVE:
Work restarted on October 31. The contractor began work on the gravity
sewer line. Due to the deep cuts, discovery of unknown utilities, unstable
soil conditions and flooded trenches, the construction averaged 20ft of
pipe installed per day. The original project schedule called for
approximately 40ft of pipe installed per day. The contractor anticipates
making up time when he starts shallow trenching along the new access road.
The completion date of January 15, 1989 is still feasible.

4. Martinez Detention Facility
a. Design
The contract for the construction documents, bidding and construction phase
services were approved by the Board of Supervisors on November 29. The
Consulting Services Agreement is being reviewed by County Counsel before
being sent to The Design Partnership for their approval.

The Architect's basic fee is $2,705,923 of which $2,330,386 (86%) has-
been paid. In addition, the Architect has been authorized $376,020
for extra services, of which $132,942 (35%) has been paid.
b. Construction:
The West County Justice Center financial report includes two
contracts:
1) The first contract was for the rough grading of the project site
(Contract "A") which is substantially complete.
The remaining contingency for Contract "A" is in deficit by
($24,508), if all changes are issued.
2) The second contract is for the construction of the detention
facility (Contract "B").
The remaining contingency for Contract "B" is $1,208,610.

The attached cost curve compares the cumulative actual value of work
completed as of the report date (11/25/88) to the Contractor's forecast of
value of work completed over the contract period. The Contractor's
forecast (early start forecast and late start forecast) are based on the
values assigned to individual activities in the Contractor's initial
progress schedule. The actual value of work completed to date ($4,117,877)
includes value of permanent work accomplished plus value of permanent
materials furnished to and stored at the site. The actual amount of
payment to the Contractor is the actual value of work less retention.

Since FY86-87, $338,900 in County funds has been encumbered for the
planning, design and management of the various projects at the MCDF. To
date, $287,171 of the total encumbrance has been paid to the professional
consultants.
b. Construction:
The Marsh Creek Detention Facility financial report includes two contracts:
1) The first contract is for the design, fabrication and installation of
two 120-bed modular dormitories. The contract award was $2,449,000 of
which $116,619 is a supplemental work allowance for change orders.
2) The second contract is for the construction of a Wastewater Treatment
Facility and related infrastructure. This work is being executed on a
time and materials basis with a contract limit of $735,000.
