HomeMy WebLinkAboutMINUTES - 03071989 - T.5 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA T. 5 Adopted this Order on March 7, 1989 by the following vote: AYES: Supervisors Powers, Fanden, Schroder, McPeak and Torlakson NOES: None ABSENT: None ABSTAIN: None --------------------------------------------------------------------- --------------------------------------------------------------------- SUBJECT: Hearing On Rezoning Application 2812-RZ, Development Plan 3032-88, and Subdivision 7152 By Garrett Development and William E. and Crowell F. Sinclair In The West Pittsburg Area. This being the time heretofore noticed by the Clerk of the Board of Supervisors for hearing on the recommendation of the East County Regional Planning Commission on the request of Garrett Development, Inc. (applicant) and William E. and Crowell F. Sinclair (owners) to rezone approximately 37 acres of land from General Agricultural District (A-2) to Planned Unit District (P-1) and Preliminary Development Plan approval ( 2812-RZ) , for approval of Final Development ' Plan 3032-88 for 148 residential sites, and for approval of Subdivision 7152, a 148 lot subdivision in the West Pittsburg area. Jean Mesick, Community Development Department, presented the staff report on the request; described the proposed site, commented on the East County Regional Planning Commission recommendation for approval, a subsequent request for reconsideration, and a vote by the Planning Commission not to reconsider the matter. She commented on the staff recommendation to accept the environmental documentation prepared for the project, approve the rezoning request along with the final development plan, adopt the East County Regional Planning Commission' s findings, and introduce the Ordinance giving effect to the rezoning. Supervisor Torlakson requested clarification on the issue of phasing in terms of the project. Jean Mesick responded to his concern commenting on the proposed locations and the delineation of Phase I and Phase II . The public hearing was opened and the following people appeared to speak: Frank Fehse, representing Garrett Development, Inc. requested that due to their support eroding because of the lateness of the day, people in support of project be allowed to testify at this time to allow them to return to West Pittsburg to pickup their children. Joy Metcalf, 134 Sandpoint Lane, West Pittsburg, commented in favor of the proposed project. Supervisor Schroder requested that people testifying comment whether they were in support of the project with the lowering of the hill. Supervisor Torlakson indicated that the lowering of the hill was a central question on this issue, and commented on the various issues including apartments as an alternative, visual impacts, open space, and the preservation of the hill. Liz Armbruster, 778 Azores Circle, West Pittsburg, spoke in favor of the project and against apartments and condominiums on the proposed location, and expressed agreement with the grading of the hill. Coralie Harless, 224 Riverside Drive, West Pittsburg, expressed support for the project and commented on benefits of the project. Mark Harless, 224 Riverside Drive, West Pittsburg, spoke in support of the proposed project, commenting that the opposition to the project appeared to come from Supervisor Torlakson and he commented on Supervisor Torlakson' s proposed alternative plan to the project. John Marques, 232 Riverside Drive, West Pittsburg, commented in opposition to apartments or parks being proposed for the area, and spoke in support of the Garrett proposal, and he spoke in favor of the grading of Hill 310 . Steven Roberti, 525 Green Street, Martinez, representing the Central Labor Council, commented on a letter from Garrett Development Ince. indicating that this will be a completely union project, and he appeared in support of the proposed project. He commented on issues including the appearance of Hill 310, the donation of a child care center, access to freeways, a proposed BART extension, the appearance of Willow Pass, and spoke in support of the grading of Hill 310. John Mass, 4211 Delta Road, Knightsen, representing the Knightsen Community Council, recommended the preservation of the Willow Pass Grade Corridor and other scenic views of the Delta. He commented for himself on property rights and preservation of historical sites. Cindy Erickson, 216 Riverside Drive, West Pittsburg, spoke in support of the Garrett Development Inc. proposed project, and commented against the preservation of Hill 310 and against the development of any more parks. Kevin Barry, 229 Manuel Court, West Pittsburg, spoke in support of the project. Richard Wilde, 1111 James Danlon Boulevard, Antioch, representing Carpenters Union #152 , spoke in support of the proposed project. Marvin Terrell, 3780 Alhambra Avenue, Martinez, Senior Business Representative of the Carpenters ' Union, spoke in support of the Garrett development. The following people representing the Carpenters' Union submitted speaker cards with comments in support of the proposed Garrett project but did not wish to speak: Cal Watterson, 1381 Hazel Avenue, Pinole. Gary Rulls, 3780 Alhambra Avenue, Martinez. Robert H. Blake, 59 Spar Court, Pleasant Hill. Clara Mota, 4350 Rio Lane, Pittsburg, commented on a brief history of the Sinclair property, and spoke in support of the Garrett project, commenting on issues including the park, child care center, and the widening of Evora Road. Bette Boatmun, 4004 Salem Street, Concord, Executive Director of the YWCA, spoke on positive aspects of the proposed project -including child care and working with the Mt. Diablo School District and the Contra Costa Water District. Frank Fehse, Garrett Development Company, presented a brief history of the requested project, and commented on issues including the historical importance of Hill 310 being contrived, the scenic corridor being enhanced with views of the Delta, the regional planning of the project, traffic, hiking and biking trails, and an alternate plan being circulated by Supervisor Torlakson. He also commented that Hill 310 is not included in the City of Pittsburg' s Hillside Preservation Plan and is not a protected hill under their ordinance. Supervisor Fanden expressed support for the proposed project and requested that the hearing be expedited. Supervisor Powers requested clarification on how many people present were against the project. Mr. Fehse requested the opportunity to bring forth the technical testimony on the project. Supervisor McPeak suggested taking the remaining testimony and requesting the applicant to address in rebuttal the issues and the technical information that he may want to present. Mr. Fehse agreed to Supervisor McPeak' s suggestion. Michael Williams, 110 Wildes Court, West Pittsburg, commented in favor of the development but expressed hesitancy at knocking down Hill 310 as a precedent setting action for development in this region. Supervisor McPeak requested staff to look at the grading that has occurred and what will be done in the lowering of Willow Pass Grade. Joe Stange, 419 Azores Circle, West Pittsburg, spoke in favor of the Garrett development, commenting on issues including opposition to apartments in the area, affordable housing in the area, commuting time, the park, traffic, open space, the need for single family homes in the area, and the wind factor in the area. Evelyn Davenport, 392 Shore Road, West Pittsburg, spoke in opposition to taking down Hill 310, commenting on the historical significance of Hill 310. She requested having the proposed homes and preserving Hill 310. Supervisor Powers requested further clarification from staff on the historical significance of Hill 310. Mark Dymkoski, 478 Azores Circle, West Pittsburg, spoke against the Garrett proposal in its present form, and requested that the Board require a master plan for the area before accepting any development proposals. He also commented on issues including traffic, a piecemeal approach to development in the area, and an ad hoc committee called the Willow Pass Corridor Planning Committee of which he is a member. Supervisor Schroder questioned Mr. Dymkoski on the composition of the Willow Pass Corridor Planning Committee. Marta Self, 89 Davis Road, Orinda, McGill, Martin, Self, presented a brief perspective of an alternative study for the Sea Breeze project. She commented on the purpose of the plan to propose the same single family home as Garrett with two differences, the preservation of Hill 310 and the preservation of the natural Delta view through that area. Supervisor Powers requested clarification on whether the alternative plan had been supplied to the County staff, who had requested preparation of the alternative plan, and requested that Ms. Self supply a copy of the plan to staff and to the applicant. Supervisor Torlakson responded with a history of the generation of the alternative plan. Stan Wruble, 484 Clifford Court, West Pittsburg, spoke in favor of the Garrett proposal. The following people submitted comments in support of the Garrett proposal but did not wish to speak: Albert R. Compaglia, 921 Ulfinian Way, Martinez. Phyllis Anderson, 318 Rosemarie Place, Pittsburg. Arlis G. Paslay, P.O. Box 2172, Martinez. Patricia Landa, 212 Riverside Drive, Pittsburg. Supervisor Torlakson commented on the lateness of the hour and expressed that he would like to direct staff to respond to issues including what is planned for the total Evora Road corridor, commute traffic, and he recommended that the hearing be continued to March 21, 1989 on the afternoon calendar, and to have staff discuss the CEQA process and a checklist of the significant issues examined by staff for this project. He also requested clarification on the 1987 General Plan designation for multiple family development. He requested that staff provide photos of development in the area and that they analyze the photo montage presented by the developer, and that they address the issue of a master plan for the area. . Supervisor Schroder clarified that in the testimony heard today he had heard no objection to the number of units being proposed, the type of units being proposed or the price of the units being proposed. He commented that he had heard very little testimony for the retention of Hill 310. He requested the applicant provide in two weeks the number of units, the type of dwelling units and the price of the units and a revised development plan with the retention of Hill 310. Frank Fehse responded that he would provide that information and requested that he be first on the agenda at the next meeting. The Board discussed various issues they would like staff to respond to at the next meeting. Supervisor McPeak requested staff to respond to the issue of Evora Road, the alignment of the circulation, and the frontage road and the trails. She requested that staff also look at what is going to be the alignment of Highway 4. She also commented on the need for master planning, the types of grading and cuts and fills that would take place, and having the applicant address the issue of drought resistant planting and landscaping. Supervisor Fanden commented on the skewed importance being given to Hill 310, the importance of up-scale housing to Pittsburg, and the promotion of the view of the Delta. Supervisor Powers requested clarification from staff on the issue of doing a master plan in the area before this project is approved. Victor Westman, County Counsel, clarified the definition of a master plan. Supervisor Powers requested clarification on the issue of the traffic and the lack of capacity on Highway 4. John E. Thill, 11975 El Camino Real, San Diego, representing Garrett Development, expressed agreement with the March 21, 1989 continuance date and requested that all the Supervisors be present and that their presentation be heard first on the agenda and that public testimony would be closed. Supervisor Torlakson clarified that the motion was to continue the hearing. Supervisor Powers commented on the public hearing process and recommended getting back into the procedure. Supervisor Schroder commented that normal procedure was to take new testimony. David Gold, 1855 Olympic Boulevard, Walnut Creek, McCutcheon, Doyle, Brown and Enersen, representing Garrett Development, commented on the process of the hearing. Supervisor McPeak expressed support for continuing the hearing and at that time taking testimony from those who had not testified and allowing the applicant to respond in rebuttal, providing summation including their expert testimony. A The Board discussed the hearing process to take place on March 21 , 1989. Supervisor Schroder clarified that people who had testified today would not speak at the next hearing and the people who had not testified today would be allowed to speak at the next hearing. Karl Wandry, Community Development Department, advised the Board that on the question of economic viability, that staff would not be prepared to produce something on the economic viability other than what the applicant would produce. Therefore, IT IS BY THE BOARD ORDERED that the hearing on rezoning application 2812-RZ, Development Plan 3032-88 and Subdivision 7152 filed by Garrett Development, Inc. and William E. and Crowell F. Sinclair in the West Pittsburg area is CONTINUED to March 21, 1989 at 2: 00 p.m. ; and staff is DIRECTED to respond to concerns raised by Board members today on various issues. 1 hereby certify that this is a true and correct Copy of an action taken and entered on the minutes of the Board of Supervisors on th date shown.
