SUBJECT: Position on AB 80
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) a BACKGROUND AND JUSTIFICATION
RECOMMENDATION
Adopt position in support of AB 80 , if amended, which is similar
to that taken on AB 3298 the last legislative session.
FINANCIAL IMPACT
None.
BACKGROUND
AB 3298 has been re-introduced as AB 80 by Assemblymember Killea.
This bill again re-emphasizes the need for recycling planning and
programs and provides for a requirement that a recycling plan be
developed for each county and be submitted to the Department of
Conservation, Division of Recycling forxeview -andapproval. The
inclusion of this latter requirement is identical to such a re-
quirement in AB 3298, previously introduced.Board
caused prob-
lems between the California Waste Management Board and Department
of Conservation and ultimately lead to it being vetoed by the
Governor last session. . Therefore, it is recommended that AB 80
be supported with the following amendments:
1. Designate the California Waste Management Board instead of
the Department of Conservation as the lead State agency,
with the caveat that the California Waste Management Board
be. strengthened with regard to planning and implementing a
statewide integrated waste management system. Coordination
with the Department of Conservation would occur during the
review of the recycling plan. Since the recycling plan is
to be included as part of the County Solid Waste Management
Plan, the administering agency should be the same as that
which provides oversight for the county solid waste manage-
ment plans, which is the California Waste Management Board.

As the lead agency, the California Waste Management Board
should provide technical assistance in the preparation of
recycling plans in order that counties clearly understand
the requirements.
2. Delete the reference which excludes inclusion of waste-to-
energy fuel as part of the waste reduction goal. Waste-to-
energy projects can be a viable means of resource recovery
and waste reduction. In Contra Costa County, Gaylord Con-
tainer Corporation, one of the nation' s largest manufactur-
ers of recycled paper stock, uses wood chips as energy to
fuel its mill. This is an important method for waste reduc-
tion for this jurisdiction.
