SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND
JUSTIFICATION
I. Recommended Action:
APPROVE Purchase Agreement and ACCEPT Grant Deed dated
February 17, 1989 from Bruce L. Lance.
AUTHORIZE Chief Engineer to execute the Purchase Agreement on
behalf of the District.
APPROVE payment of $278, 000.00 for said property rights and
AUTHORIZE the Auditor-Controller to issue a check in said
amount payable to Fidelity National Title, Escrow No. 151036
to be forwarded to the Real Property Division for delivery.
DIRECT the Real Property Division to have the above
referenced Grant Deed recorded in the office of the County
Recorder.

II. Financial Impact:
Payment of $278, 000 from Flood Control District Zone 3B funds
which are possibly reimbursable from State Department of
Water Resources at a future date.
III. Reasons for Recommendations and Background:
These property rights are required for the future San Ramon
Creek Channel improvement project in accordance with approved
plans.
IV. Consequences of Negative Action:
This property has been offered for sale by the owner and a
large portion of it will be needed for widening of San Ramon
Creek. . Purchase of this parcel now will prevent costly
prolonged negotiations, payment of severance damages, and
condemnation at a later date if District has to purchase the
property rights from an unwilling seller.
