BOARD OF SUPERVISORS FROM: Water Committee Contra Supervisor Sunne McPeak Supervisor Tom Torlakson Costa DATE: March .28, 1989 County SUBJECT: Water Legislation County SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION Take the following- positions, as Governing Board of the Contra , Costa Water Agency, on the legislation below: ACR 43 (Katz et al) -- Water Conservation in the Imperial Valley ( 3/6%89) -- Support AB 680 (Baker) -- Freeway Landscape Legislation: Reclaimed water ( 2/15%89) -- Support AB 2210 (Campbell) -- Bay Delta Protection Bill ( 3/10%89) -- support SB 405 (Ayala) -- water Quality Standards - State and Federal Projects ( 2%7j89) -- Oppose FINANCIAL IMPACTS None. REASONS FOR RECOMMENDATION%BACKGROUND At their meeting on March 20, 1989, the Board of Supervisors' Water Committee considered each of the proposed legislative bills and examined the rationale that justified the above-stated positions for consistency with the County' s established water policy. A summary of the bills and rationale for the County positions is on file with the Community Development Department. Dept . ) ATTESTED __ MAR 2 Q 1989 _ County Legislative Delegation (via CDD) PHIL BATCHELOR, CLERK OF THE BOARD OF County Administrator SUPERVISORS AND COUNTY ADMINISTRATOR M382/7-83 BY ,DEPUTY it POSITIONS OF THE CONTRA COSTA WATER AGENCY ON SELECTED 1989 LEGISLATION (FOR BOARD OF SUPERVISORS' CONSIDERATION MARCH 28, 1989) ACR 43 - KATZ ET AL - WATER CONSERVATION IN THE IMPERIAL VALLEY Summary The Metropolitan Water District of Southern California and the Imperial Irrigation District are commended for successful water marketing efforts and implementation of water conservation methods, reducing water needed by farmers and supplying this excess to metropolitan water users. This legislation endorses these measures, and encourages other entities to consider similar solutions. Recommended Position Support. Rationale Alternative uses for efficient use of existing water, agricultural conservation measures, and the concept of water marketing are all measures strongly supported by the County. AB 680 - BAKER - FREEWAY LANDSCAPE LEGISLATION: RECLAIMED WATER Summary This bill would authorize the Department of Transportation to test and evaluate use of reclaimed water along Highway 680 for landscape irrigation. Recommended Position Support. Rationale This legislation is consistent with County conservation policy, and recent County Board of Supervisors' support of East Bay Municipal Utility District efforts for water reclamation projects in the San Ramon Valley. ' AB 2210 CAMPBELL BAY-DELTA PROTECTION BILL Summary This bill specifies Bay-Delta protection as a State policy, and as such, the Department of Water Resources must operate the State Water Project in a manner which mitigates negative impacts caused by operation of the State Water Project. This legislation further stipulates that water necessary for preservation of reasonable and beneficial oaeo of the bay will not be exported. Recommended Position Support. Rati � nale This bill advocates measures which have historically been strongly supported by the County, and constitute much of County policy. SB 405 - AYALA - WATER QUALITY STANDARDS - STATE AND FEDERAL PROJECTS Summary This bill would require the State Water Resources Control Board (SWRCB) to maintain water quality standards at a level consistent with standards existing prior to installation of the CVP and SWP, in proceedings regarding the CVP and BWP. This bill would further specify that maintenance of any stricter water quality standards implemeoted later would be the responsibility of upstream "depletera"' of Bay-Delta waters' Recommended Position Oppose. Rationale This bill calls for the GWBCB to use "without project level" water quality standards in their future decisions regarding the Bay-Delta Hearings. "Without project levels" do not provide for a fair consideration of Bay-Delta water quality as acknowledged by the courts in the Figone and Racannelli Decisions. Additionally, to specifically exclude the State Water Project and the Central Valley Project from meeting water quality standards higher than "without project levels" should be oppoaed- RG:ja1 ]l9:leg,doo _2- - ' - | | / .
