Determination of Property Tax
Exchange for Bettencourt
Boundary Reorganization RESOLUTION No. 89/ 198
(LAFC 88-47)
WHEREAS, Section 99.1 of the Revenue and Taxation Code provides that a
jurisdictional change resulting from a special district providing one or
more services to an area where such services have not previously been
provided shall not become effective if one or more affected special
districts involved in the property tax exchange negotiation fails to adopt
a resolution agreeing to a transfer; and
WHEREAS, the Board of Supervisors shall determine the property tax
exchange for each affected district that fails to adopt a resolution
agreeing to a property tax transfer, except for the annexing district: and
WHEREAS, the Bettentcourt Boundary Reorganization (LAFC 88-47)
involves annexation of territory to Central Contra Costa Sanitary District
(CCCSD),, East Bay Municipal Utility District (EBMUD) and County Service
Area L-100 (CSA L-100) for which property tax exchange is determined by the
previously approved master property tax exchange agreement or Board of
Supervisors Resolution No. 86/541; and
WHEREAS, the reorganization proposes concurrent annexation of
territory to County Service Area P-2A (CSA-2A) and no resolution has been
adopted agreeing to property tax exchange regarding CSA P-2A; and
WHEREAS, there shall be no property tax transfer to CSA P-2A as a
result of this reorganization.
THEREFORE, BE IT BY THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY
RESOLVED that the property tax increment allocation factors for the
affected agencies in the area of the Bettencourt Boundary Reorganization
(LAFC 88-47) shall be in accordance with the terms of the master property
tax transfer agreement between the County, CCCSD and EBMUD; Board of
Supervisors Resolution No. 86/541 regarding CSA L-100 and this resolution
regarding CSA P-2A for the fiscal year for which the State Board of
Equalization makes the tax rate area changes for this jurisdictional
change. Said factors shall apply in subsequent years unless changed by the
mutual agreement of affected agencies or subsequent jurisdictional changes.
Said increment tax allocation factors apply to affected territory as
submitted or revised by the Local Agency Formation Commission. This
resolution does not change the affected districts' right to collect taxes
for existing bonded indebtedness.
