SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND
JUSTIFICATION
I. Recommended Action:
APPROVE Right of Way Contract and ACCEPT Temporary
Construction Easement dated February 24, 1989 from Dennis F.
& Mary E. Tierney.
AUTHORIZE Chief Engineer to execute said Right of Way
Contract on behalf of the District.
APPROVE payment of $700.00 for said property rights and
AUTHORIZE the Auditor-Controller to issue a check in said
amount payable to Dennis F. & Mary E. Tierney, to be
forwarded to the Real Property Division for delivery.

II. Financial Impact:
Payment of $700.00 from Flood Control District Zone 3B funds
which are 100% reimbursable from State Department of Water
Resources.
III. Reasons for Recommendations and Background:
These property rights are required for the San Ramon Creek
Bypass project in accordance with approved plans and
specifications.
V. Consequences of Negative Action:
The project will not have sufficient land rights to allow
construction in accordance with the approved plans and
specifications.
