HomeMy WebLinkAboutMINUTES - 03211989 - T.4 T. 4 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on March 21, 1989 by the following vote: AYES: Supervisors Powers, Fanden, Schroder, McPeak and Torlakson NOES: None ABSENT: None ABSTAIN: None SUBJECT: Hearing On Rezoning Application 2812, Development Plan 3032-88, And Subdivision 7152 By Garrett Development And William E. And Crowell F. Sinclair In The West Pittsburg Area. On March 7, 1989, the Board of Supervisors continued to this date the hearing on the recommendation of the East County Regional Planning Commission on the request of Garrett Development, Inc. (applicant) and William E. and Crowell F. Sinclair (owners) to rezone approximately 37 acres of land from General Agricultural District (A-2) to Planned Unit District (P-1) and Preliminary Development Plan approval ( 2812-RZ) , for approval of Final Development Plan 3032-88 for 148 residential sites, and for approval of Subdivision 7152, a 148 lot subdivision in the West Pittsburg area. Supervisor Torlakson commented on the issues that had been raised at the last hearing and presented a perspective of the status of the matter and he outlined a direction for today' s hearing. He commented on an alternative proposal to save Hill 410 rather than Hill 310 and on a proposed alternative plan to save Hill 310 and tying this area into a trails master plan. He advised that he would be moving to add to the Boga Ranch General Plan the rest of the Evora Corridor to be considered in context together as a consolidated General Plan to get the overview master plant for the traffic in the corridor. Karl Wandry, Community Development Department, commented on a staff report to the Board dated March 17, 1989 responding to the issues raised at the March 7, 1989 meeting and a profile done by Steve Wright, Community Development Department, showing the gradients proposed on Highway 4 and Evora Road. He presented the staff recommendation to accept the environmental documentation prepared for the project as being adequate, approve the rezoning application, final development plan and tentative map as recommended by the East County Regional Planning Commission, including their conditions and adopt the East County Regional Planning Commission' s findings but as the Board goes through the compromise outlined by the Chairman, the finding would change; and he requested that the Board introduce the ordinance giving effect to the rezoning and staff would return in two weeks with the findings with the modified conditions as a result of this hearing. He addressed various issues including circulation, trails, open space, the historic designation of the hill, and irrigation. The following people appeared to speak: John Thill, 11975 E1 Camino Real #300, San Diego, President, Garrett Development, made a presentation on the proposed project and commented on the preservation of Hill 410 rather than Hill 310 and the amount of open space in the project. He commented on the benefits of the proposed project to the community. Donald J. Rose, 1657 North California Boulevard, Suite 200, Walnut Creek, Rose Associates, Landscape Architect on the project, commented on the drought resistant landscaping plan for the proposed project. Craig D. Covert, 7501 Stoneridge Drive, Pleasanton, Carlson, Barbee, Gibson and Covert, addressed the plan in general, and the acceptability of the plan. Supervisor Torlakson commented on possible slide areas on Hill 310. Nancy L. Parent, Mayor, City of Pittsburg, commented two letters expressing concerns about this project and the consistency with the City of Pittsburg General Plan and the scenic corridor. She commented that the compromise plan would make it possible for people coming toward East County over Willow Pass Grade to be able to see the view of the Delta if the rooftops of the houses were low enough, and that the preservation of Hill 410 would provide for open space and use for scenic purposes. She expressed that the City was in favor of linking up Central County with East County through a trail mechanism. She expressed appreciation to the Board of Supervisors for considering the plans of the City of Pittsburg since this is within their planning area and adjacent to their sphere of influence. Richard Ratto, 8 Sea Cliff Place, West Pittsburg, spoke in opposition to the proposed project, and commented on doing the project correctly. Janess Hanson, 431 Levee Road, West Pittsburg, speaking for herself and as a member of the Willow Pass Corridor Planning Committee, spoke in support of the single family upgraded Sea Breeze units but expressed concerns that they wished to have the County address, including the desire for a Master Plan for the entire Willow Pass Corridor area to address the problems of growth, and preserving the Willow Pass Grade as a scenic corridor. Antonia Wirth, 49 Anchor Drive, Pittsburg, submitted a card yielding her time to speak to Janess Hanson. Bob Doyle, Assistant General Manager, East Bay Regional Park District, Real Estate and Land Acquisition, spoke on the long term master plan for a regional trail, the closure of the Port Chicago Highway, the funding of trails and park plans by Measure AA and Measure C, engineering needed in the trail system, and focusing on a trail. Estuardo Solbavarro, 415 West 9th Street, Antioch, commented against the proposed project. David Campos, 4321 Goldenhill, Pittsburg, commented on the issue of open space. Ric Clonce, 232 Sandy Cove Lane, West Pittsburg, spoke on traffic issues. Supervisor Torlakson read a card in favor of Garrett Sea Breeze project as it was originally proposed from Larry Dewes, 101 Wildes Court, West Pittsburg, who submitted the card on March 7, 1989 but was not present today. Julio Sanchez, 40 Pomo Court, West Pittsburg, spoke in favor of the proposal. Bud Renalds, 205 Manuel Court, West Pittsburg, spoke in favor of the proposal. The Chair read cards from Alex Dongallo, 29 Dolphin Drive, Pittsburg, who could not stay, wishing to address traffic problems, schools impact, water problems and concern about saving open space. Roy R. Davenport, 392 Shore Road, West Pittsburg, representing Save Willow Pass Corridor, spoke on the preservation of Hill 310 and asked what hill could be saved. Rod Mullen, 196 River Side Drive, West Pittsburg, did not speak but submitted a card in favor the the Sea Breeze project. Barbara Bonnickson, 613 2nd Street, Brentwood, spoke in favor of the preservation of Hill 310. The Chair submitted cards from people who did not wish to speak but are in favor of the project: Cindy Erickson, 216 Riverside Drive, Pittsburg. Colleen J. Riat, 509 Mota Drive, West Pittsburg. Liz Armbruster, 778 Azores Circle, West Pittsburg. Mark Harliss, 224 Riverside. Sandra Fernandez, 240 Sandy Cove Lane, Pittsburg. Coralie Harless, 224 Riverside Drive, Pittsburg. Rynette Williams, 251 Sandy Cove Lane, West Pittsburg. Mary Ida Enes, 418 Azores Circle, Pittsburg, spoke in favor of the Garrett Sea Breeze development. The Chairman submitted a card from Al McNabney, 1161 Leisure Lane, Walnut Creek, Mt. Diablo Audubon Society, expressing concerns on preservation of open space and master planning. Kenneth Ferguson, 523 Lindley Drive, Antioch, spoke on traffic and open space issues. Tim Davis, 1021 Gatter Drive, Antioch, spoke against the proposed project. Bruce A. Fitch, 461 Skyharbour Lane, Pittsburg, spoke in opposition to approval of the project without resolving the issues involved including traffic, corridor. view, and other problems associated with the matter. Lance Erickson, 216 Riverside Drive, Pittsburg, spoke in favor of the proposed project. Supervisor Torlakson advised that there were additional speaker cards that had been submitted but that he would like to take what he had heard, what he felt and seen in the past several months and try to formulate a motion for the Board to consider. He commented on the various issues including the preservation of Hill 310, the alternative of utilizing Hill 410 for open space, traffic, the signal at Mota Drive, additional frontage improvements, resolving the problems at Pomo and Evora Roads, a traffic road alignment study of Evora Road, reimbursement through the fee benefit area for regional improvements, the contribution of the development to the fee benefit area, the grading of Hill 310 for a topographical blend, a traffic study of the Evora Road Corridor, shifting of all or part of the Evora Road improvement project to the West Pittsburg Area Of Benefit, the formation of a police assessment district, the formation of a landscaping district or a form of assessment district to assure the landscaping of the open space possibly through the Ambrose Park and Recreation District, a trail connection between the east end of the project and the existing trail system to interlink Delta Glen and Sea Breeze, the historic monument marker, a $50, 000 contribution by Garrett to the homeless issue, reimbursement of regional road issues, and he moved approval of the Garrett Project Phase I with the conditions he outlined, directing staff to prepare the final language on those to return at the earliest opportunity. Supervisor Powers seconded the motion clarifying that this was approving the compromise plan and that the motion was to declare the Board' s intent to approve the project subject to the matter being brought back to the Board in two weeks with the proper detail. Supervisor McPeak indicated support for the motion and commented on the compromise that had been worked out, and she requested that a calculation of the percentage area of turf be provided to the Board in two weeks. Supervisor Schroder commented on the paradox that because of the requirements being placed on this project that the cost of the housing would increase. Supervisor Fanden indicated support for the proposed motion and she indicated agreement with Supervisor Schroder' s comments. Supervisor Torlakson requested that anyone who had submitted a speaker card come forward to speak on the motion that was on the floor. Supervisor Fanden requested clarification on the number of units being approved. Supervisor Torlakson indicated that this would be an approval of 138 units. Richard Barrett, 424 Azores Circle, West Pittsburg, spoke in favor of the proposal. IT IS BY THE BOARD ORDERED that the Board of Supervisors hereby DECLARES ITS INTENT to approve Rezoning Application 2812-RZ, along with Final Development Plan 3032-88 and Tentative Map 7152 with .amended conditions; to introduce the Ordinance giving effect to the rezoning; to approve and adopt property tax exchange resolution for Garrett-Sea Breeze Boundary Reorganization (LAFC 88-51) ; and Community Development Department is DIRECTED to prepare the appropriate documentation for Board consideration on the April 4, 1989 Determination Calendar.
