HomeMy WebLinkAboutMINUTES - 03211989 - T.2 T. 2 THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY, CALIFORNIA Adopted this Order on March 21, 1989 by the following vote: AYES: Supervisors Powers, Fanden, Schroder, McPeak, and Torlakson NOES: None ABSENT: None ABSTAIN: None ------------------------------------------------------------------- ------------------------------------------------------------------ SUBJECT: Hearing on proposed condemnation of real property on Livorna Road, Alamo area. This is the time set to hear the proposed condemnation of. certain real property on Livorna Road in the Alamo area. The Public Works Director advised that he had received a request from a Mr. Jim McKeehan, the attorney for the developer, requesting that this item be continued for one week because the owner had not been provided with a written copy of the statement of summary for the basis of payment, and that the owner had requested that and had merely been furnished the total amount that they were offering him and he had asked for information as to how they, had arrived at that figure. Mr. Clifford Hirsch appeared and advised that he disagreed with the above, and asked that he be allowed to respond. The Chair inquired of Mr. Schroder, Supervisor from District III , if he had a recommendation on whether to continue the hearing to March 28, 1989. Supervisor Schroder recommended that Mr. Hirsch be invited to present his comments, and it would then be his intent to refer the matter to Public Works and County Counsel relative to the allegations being made by Mr. Hirsch. County Counsel concurred that the hearing should be continued today and not opened, that the matter is not ready to proceed. He noted that Mr. Hirsch was advised this morning that was going to be the staff ' s recommendation and he chose to come to this meeting. Mr. Hirsch declared that he was advised the hearing was going to be continued, but not given the reason. Chairman Torlakson declared that Mr. Hirsch would be heard as a public comment, and after hearing the public comment the Board would determine whether to open the public hearing or continue it. Mr. Hirsch submitted two documents to Board Members and the Public Works Director, one being a February 10, 1986 memorandum to the Director of Community Development from the Public Works Director relating to the development of the Bogue Ranch, Alamo; and the second being a May 12, 1986 letter to Community Development from Signature Properties, also on the development of the Bogue Ranch and Livorna Road. The Board discussed with staff whether to open the hearing or refer the material to staff for review and recommendation and defer the matter until next week.
