RECOMMENDATION•
Introduce the attached ordinance, waive reading, and fix March
28, 1989 for adoption.
BACKGROUND:
On February 28, 1989, the Board of Supervisors directed County
Counsel to prepare an ordinance which requires the installation
of sprinklers in newly constructed buildings which exceed 10,000
square feet in area, unless area separation walls are used which
have no openings, but in all cases requires the installation of
sprinklers in newly constructed buildings which exceed 20,000
square feet, regardless of the presence of area separation walls
with certain specified exceptions. County Counsel was asked to
circulate the ordinance to the fire districts, Building
Inspection, BIA and AGC. Any comments were to be returned to our
Committee on March 13 , 1989 .
On March 13 , 1989, our Committee met with representatives of the
Fire Districts. All parties appear satisfied with the attached
ordinance, which we believe is now ready for adoption. Attached
is a copy of the ordinance and County Counsel ' s memo describing
the effect of the ordinance.

(Amendments To Building Code Regarding Sprinkler
Systems And Area Separation Walls . )
The Contra Costa County Board of Supervisors ordains as follows
(omitting the parenthetical footnotes from the official text of
the enacted or amended provisions of the County Ordinance Code) :
SECTION I . SUMMARY. This ordinance amends Title 7 of the County
Ordinance Code to provide that Ordinance No. 87-100's provisions
on area separation walls and sprinkler systems apply only to
buildings for which building permits are issued on or after the
effective date of this ordinance.
SECTION II . Section 74-3 .503 of the County Ordinance Code, as
added by Section II of Ordinance No. 87-100, is repealed in its
entirety and replaced with Section 74-3.504, to read:
74-3.504 UBC Sec. 505, area separation walls. (a) For new
buildings for which building permits are issued on or after
Leffective date of ordinancel , the introductory paragraph of
Subsection (e) of Section 505 is amended, to read:
" (e) Area Separation Walls . Each portion of
a building separated by one or more area '
separation walls may be considered a separate
building provided the area separation walls
contain no openings unless the building is
protected throughout with an approved
automatic fire extinguishing system, as
specified in Chapter 38, and the walls meet
the following requirements: "
(b) For purposes of this section, "new building" includes a
building which replaces a pre-existing building which has been
substantially destroyed. The building inspector shall determine
whether a building has been substantially destroyed. This
section does not apply to additions to or alterations of
buildings for which building permits have been issued before
Leffective date of ordinancel .

SECTION III . Section 74-3 . 3801 of the County Ordinance Code, as
added by Section III of Ordinance No. 87-100, is repealed in its
entirety and replaced 'with Section 74-3 .3802, to read:
74-3.3802 UBC Sec. 3802, Automatic Fire-extinguishing
Systems. (a) For new buildings for which building permits are
issued on or after (effective date of ordinancel, subsection (h)
is added to UBC Section 3802, to read:
" (h) All Occupancies. An automatic sprinkler system
shall be installed:
1 . In all buildings when the total floor area,
including mezzanines, exceeds 10, 000 square feet.
2 . In all buildings separated by one or more area
separation walls without openings when the total floor
area, including mezzanines, exceeds 20, 000 square feet.
EXCEPTIONS to paragraphs 1 and 2:
A. Agricultural buildings.

B. Group B, Division. 3, open parking
garage buildings containing no other
occupancies and where exterior walls
containing openings are located not less than
20 feet from an adjacent property line or
center street line or public space.
C. When determining a building's total
floor area, the floor area of mechanical
rooms of not more than 50 square feet and
separated from the remainder of the building
by not less than a 1 hour fire resistive
occupancy separation need not be considered. "
(b) For purposes of this section, new building" includes a
building which replaces a pre-existing building which has been
substantially destroyed. The building inspector shall determine
whether a building has been substantially destroyed. This
section does not apply to additions to or alterations of
buildings for which building permits have been issued before
jeffective date of ordinancel .

SECTION IV. EFFECTIVE DATE. This , ordinance becomes effective 30
days after passage, and within 15 days of passage shall be
published once with the names of the supervisors voting for and
against it in the Contra Costa Times, a newspaper published in
this County.

Re: Amendment to Building Ordinance applying provisions of Ord. No.
87-100 (on area separation walls and sprinkler systems in
buildings exceeding 10,000 square feet) to new buildings only.
Pursuant to directions from the Board on 2-28-89, attached is a
copy of the subject ordinance. A prior draft was reviewed by the
Director of Building Inspection and the Consolidated, Riverview and
West County Fire Protection Districts. Comments were received from
Chief Harguth of the Consolidated Fire Protection District only, and
the attached draft incorporates his suggestion.
In summary this ordinance:
1 Applies Ord. No. 87-100's prohibition against openings in
area separation walls unless the entire building is installed with a
sprinkler system to new buildings only, and not to additions to or
alterations of existing buildings.
2 . Applies Ord. No. 87-100's requirement that buildings
exceeding 10,000 square feet in size be installed with a sprinkler
system to new buildings only, and not to additions to or alterations
of existing buildings .
3 . Requires sprinkler systems in "buildings" exceeding 20,000
square feet in total floor area irrespective of separation or
compartmentalization by area separation walls without openings .
4 . Specifies that new buildings are those issued building
permits on or after the effective date of this ordinance, and
includes a building replaced after it has been substantially
destroyed in the opinion of the building inspector.
5 . Does not make reference to the Fire Code's requirements for
buildings housing hazardous chemicals because UBC § 3802(a) already
makes such a reference.

6 . Repeals the two Ordinance Code sections added by Ordinance
No. 87-100 .
