Request the County Administrator to report to our Committee on April 10, 1989 at 8:30 A.M. on all legislation pending in the California Legislature which addresses the issue of tax credits of any type for child care expenses, whether for individuals or for employers. 2 . SUPPORT in concept the Child Care Partnership legislation introduced by Assemblywoman Speier (see attached draft of the legislation as introduced) . 3 . Request the Child Care Task Force and the Child Care Council to make a presentation on the subject of child care to the Contra Costa Mayors ' Conference and request the Executive Director of the Child Care Council to arrange to appear on their agenda at the earliest opportunity. 4 . Request the Director of Community Development to prepare a contract with the Contra Costa Child Care Council for the child care broker function, utilizing the $35,000 which has already been committed for this purpose and return the contract to the Board of Supervisors by April 4, 1989. 5 . (continued) Affordability Fund, either from an increase in the Transient Occupancy Tax or from other revenue sources which are available to the cities. Request the County Administrator' s Office to staff this meeting and prepare a report back to our Committee for our meeting on April 10, 1989 . 6. Request the Social Services Director and Executive Director of the Private Industry Council to attend our next meeting with the Child Care Task Force on April 10, 1989 at 8: 30 A.M. to discuss the purchase of exempt child care by the County. 7 . Remove as a referral to our Committee the issue of changes in the federal child care tax credits which was referred to our Committee December 13, 1989, leaving on referral to our Committee the responsibility to provide liaison and staffing for the Child Care Task Force. BACKGROUND: On December 13, 1989, the Board of Supervisors referred to our Committee an assignment which had been made to the County . Administrator ' s Office to determine the cost of the Board' s proposed changes in the federal income tax child care tax credits. We have previously reported this matter back to the Board on February 28, 1989 and have now discussed the report with the members of the Child Care Task Force at our meeting on March 13 , 1989. We are asking the County Administrator to submit a report to our Committee on all State legislation which has been introduced which deals with tax credits for child care expenses, whether incurred by the employee or employer. As a result, there is little reason to retain on referral the issue of changes in the federal child care tax credits, although we will follow with interest movements being made by the Federal Administration and Congress to address the problems with the child care system. On December 13, 1989, the Board of Supervisors also authorized our Committee to provide liaison and staff support to the Child Care Task Force. We met with the Child Care Task Force on March 13, 1989 and plan to meet with them again on April 10, 1989. We discussed the attached Child Care Partnership legislation which has been prepared by the CSAC Child Care Committee, whose legislative committee is chaired by Supervisor McPeak. A copy of the legislation is attached for the information of the Board Members. The CSAC Child Care Committee will be meeting again on Wednesday, March 22, 1989 at 10: 00 A.M. in the CSAC Conference Room in Sacramento. We have invited members of the Child Care Task Force to join us for that Committee meeting. We received a report from the Community Development Department staff on the assignment involving asking the cities to increase their Transient Occupancy Tax (TOT) with the proceeds to be dedicated to the Child Care Affordability Fund. As the attached memo from Mr. Bragdon notes, the Child' Care Council has agreed to approach the cities as soon as their current fund-raising effort is completed. It may be that some cities will want to use a revenue source other than the TOT to assist in funding the Child Care Affordability Fund--which is certainly acceptable to our Committee. In an effort to move this effort ahead, we have asked that the Child Care Council convene a meeting on April 6 with Supervisor McPeak, the four city councilpersons who served on the Child Care Task Force, and one or two other city councilpersons who have expressed a particular interest in the subject of child Page 3 care. This meeting will attempt to identify a revenue stream which cities might be asked to use for the Child Care Affordability Fund. We have also asked the Child Care Council to schedule a presentation on child care for a forthcoming meeting of the Contra Costa Mayors ' Conference in an effort to get the support of the Mayors for the need to do something to support the child care system in this County. In regard to the child care broker function, the County now has $35, 000 available for this purpose and we believe that it is important that the County enter into a contract with the Child Care Council as soon as possible so the child care broker function can truly move forward and be implemented in this County. The $35,000 includes $10, 000 which has already been pledged by the County, $10,000 which has been pledged by the development community, and $15, 000 which has been pledged by the United Way. An additional problem was brought to our attention by the Executive Director of the Child Care Council. This is the question of the extent to which it is appropriate for the County, in an effort to save money, to purchase non-licensed or exempt child care for various clients both under the GAIN Program and under the PIC Program. General Subject: Child care: partnership for child care. Existing law provides for the licensure and regulation of child day care facilities. This bill would create the California Child Care . Partnership Council , as specified. It would impose a number of duties on the council, including the preparation of a needs report of child care needs to be submitted to the Governor and Legislature, the preparation of the California Partnership for Child Care Action Plan to be submitted to the Governor and Legislature, and preparations of updates of the needs report and action plan. This bill also would authorize the board of supervisors of a county to submit a community child care plan to the council for its certification by an 16218 89066 13 : 01 RECORD # 40 BF: RN 89 005977 PAGE NO. 2 f unspecified date and would authorizea city or consortium of cities within a county to submit a community child care plan to the council for its certification within an unspecified time period if the board of supervisors of its county does not submit a community child care plan to the council. The bill would require the council to adopt guidelines for the adoption of a community child care plan by a county, city, or consortium of cities. The bill would require the council to certify a community child care plan if specified requirements are satisfied. This bill furthermore would create the California Child Care Partnership Fund. It would require the fund to be administered by the council . It would require the fund to contribute $1 dollar for each dollar contributed to a community child care fund by contributors from the public and .private sectors of the local community, unless otherwise specified. The bill would require the council to adopt guidelines for the establishment of community child care funds which are eligible for matching funds, and would provide that a community child care fund shall be eligible for matching funds if it satisfies specified requirements. The Legislature finds and declares all of the following: (a) The availability of affordable, quality child care is vital to the future economic viability of the State of California and the well-being of its families. (b) It is in the best interest of California and its families to foster a coordinated, comprehensive child care system which maximizes parental responsibility and parental choice. (c) Child care needs statewide are diverse and complex; no single approach fits all communities . Existing resources are also diverse and vary in their availability from community to community. The State of California' s effort to meet child care needs must recognize community differences, allow for a pluralistic system, and encourage local innovation and initiative. (d) The most effective and efficient leadership role for the State of California is to foster a comprehensive child care system which complements existing resources and encourages further public and private collaboration and investment in child care at the local 16218 89066 13 : 01 RECORD # 60 BF: RN 89 005977 PAGE NO. 3, r level. (e) Meeting the child care needs is a societal problem which impacts many sectors of the state. and its communities. Therefore, it is essential to involve as partners in the child - care system those elements of the community which impact the need for child care and which have the opportunity to address the need. SEC. 2. Section 12. 6 (commencing with Section 25967) is added to Division 20 of the Health and Safety Code, to read: CHAPTER 12.6. PARTNERSHIP FOR CHILD CARE 25967. For purposes of this chapter, the following definitions shall apply: (a) "Council" means the California Child Care Partnership Council . (b) "Action plan" means the California . Partnership for Child Care Action Plan. (c) - "Fund" means the California Child Care Partnership Fund. 25967.5. (a) There is hereby created in state government the California Child Care Partnership Council . The council shall consist of 10 persons, as follows: 16218 89066 13 : 01 RECORD # 80 BF: RN 89 005977 PAGE NO. 4, f ( 1 ) Five members shall be appointed by the Governor. ( 2) Two members shall be appointed by the Speaker of the Assembly. (3) Two members shall be appointed by the- Senate Rules Committee. ( 4) The Superintendent of Public Instruction or his or her designee shall be an ex officio voting member . ( 4) Recommend legislation to the Governor and Legi-slature to implement the action plan. (5) Adopt guidelines for the certification of community child care plans and the establishment of community child care funds which are eligible for matching funds pursuant to this chapter . (6) Certify community child care plans . (7) Administer the California Child Care Partnership Fund. 25968. (a) The board of supervisors of a county may submit a community child care plan to the council for its certification by If the board of supervisors in a county does not submit a community child care plan to the council, a city or consortium of cities within that county may submit a community child care plan to the council- for its certification within 90 days of (b) The council shall adopt guidelines for the adoption of a community child care plan by a county, city, or consortium of cities. (2) It contains a plan to meet the child .care needs of its county, city, or consortium of cities and develop a comprehensive child care system in its county, city, or consortium of cities by mobilizing public and private resources and complementing existing resources. (3) It provides for a biannual update of the child care plan consistent with a schedule established by the council. (4 ) It fosters a child care system which maximizes parental responsibility and parental choice. (5) It sets forth the establishment and administration of a community child care fund. There may be more than one community child care fund established in a county if it is authorized in the community child care plan. (6) It is consistent with all guidelines adopted by the council pursuant to subdivision (b) . 25968. 5 . (a) The California Child Care Partnership Fund is hereby created. The fund shall contribute one dollar ($1 ) for each dollar contributed to a community child care fund by contributors from the- public and private sectors of the local community, unless otherwise specified in this chapter . The council shall determine whether a community child care fund is eligible for matching funds and the appropriate matching allocation of those funds to a community child care fund. (b) The council shall adopt guidelines for the establishment of a community child care fund which is eligible for matching funds pursuant to this chapter . (c) A community child care fund shall be eligible for matching funds from the California Child Care . Partnership Fund if it satisfies all of the following requirements: ( 1 ) It is established and governed pursuant to a community child care plan that has been certified by the council. (2) It is established principally for the purpose of providing financial assistance to parents who cannot meet some or all of the financial obligations of their child care needs. (4) The governing body of the community child care fund has adopted a policy of nondiscrimination and has implemented a public information and outreach program for all segments of the community served by the community child care fund. (5) It uses no more than 10 percent of its funds for administrative purposes . (6) It meets all other requirements established by the council by guidelines adopted pursuant to subdivision (b) . SEC. 3. It is the intent of the Legislature to provide funding for the California Child Care Partnership Fund by an appropriation to that fund made in the Budget Act for the 1989-1990 fiscal year . 0 - CONTRA COSTA COUNTY COMMUNITY DEVELOPMENT DEPARTMENT TO: Internal Operations Committee DATE: February 28, 1989 FROM: ' Harvey E. Bragdon, Di t e -SUBJECT: Request to Cities ncr NT The Community Development Department was requested to contact the cities to ask that they increase their Transient Occupancy Tax and dedicate the increased revenue to the Child Care Affordability Fund. It appears that the cities may be ,more receptive to this concept if they were approached by the Child Care Community rather than the County'. Therefore, we have discussed this informally with Kate Ertz-Berger of the Child Care Council who indicated that it is a part ,of their existing work program. Currently, the Council is in the midst of fund raising and may not be able to approach the cities for about a month. Ms. Ertz-Berger also indicated that this matter may be discussed further by the Council 's Board of Directors.
