Legislation: Senate Bill 618 (Boatwright)
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION•
Adopt a position as SPONSOR of SB 618 by Senator Boatwright which
permits the County to recover all costs of prosecuting a civil or
criminal case involving a violation of the County' s nuisance
ordinance.
BACKGROUND:
Under current law, the County has no way to recover the
substantial costs of inspection, investigation, and enforcement
of violations of the County' s nuisance ordinance, nor the cost of
County Counsel ' s time and court costs in prosecuting such cases.
At the request of County Counsel, legislation to allow the County
to recover all of these costs was made a part of the County' s .
1989 legislative program. Senator Boatwright has introduced SB
618 at the request of the Board of Supervisors to permit the
County to recover all of these costs from the property owner
where we are able to successfully prosecute such a case and
obtain a judgment against the property owner. Since SB 618 has
been requested by the Board of Supervisors,, it is appropriate for
the Board to indicate its sponsorship of SB 618.
