SUBJECT: Hearing on Appeals of Christopher Valle-Riestra on Behalf
of Save Mt. Diablo, The Sierra Club, The Mt. Diablo Audubon
Society, The Preserve Area Ridgelands Committee and People
for Open Space; and Sanford M. Skaggs Representing Robert D.
Stratmore on Subdivision 6933 in the Diablo Area.
The Board of Supervisors on June 21, 1988 continued to this date the
hearing on the appeals by Christopher P. Valle-Riestra' on behalf of Save
Mt. Diablo, The Sierra Club, the Mt. Diablo Audubon Society, The Preserve
Area Ridgelands Committee and People for Open Space; and by Sanford M.
Skaggs representing the owner, Robert D. Stratmore from the San Ramon
Valley Regional Planning Commission' s decision for approval with
conditions for Tentative Map for Subdivision 6933 ( a request by DeBolt
Civil Engineering (applicant) and Robert D. Stratmore (owner) for approval
to divide 106+ or -acres into six lots in an Agricultural Preserve
District (A-4) in the Diablo Area. )
Sanford Skaggs, 1855 Olympic Blvd. , Walnut Creek, representing the
applicant, Mr. Stratmore, commented on two issues including if the
Subdivision would violate the Williamson Act, and when and how there
should be a review of the siting of the homes. He. requested that the .
Board reject the appeals of Save Mt. Diablo and others and approve their
appeal regarding the elimination of the conditions pertaining to the
homesites leaving that for the future under the land use permit process.
Chris Valle-Riestra, 257 Vernon Street, # 321, Oakland, representing
Save Mt. Diablo, one of the appellants, spoke in opposition to the
application for this subdivision. He commented on reasons for opposing
the application including that the subdivision would be inconsistent with
the existing Williamson Act contract burdening this land. He requested
that the Board of Supervisors recognize their responsibility in this
matter and deny the application.
Mark Evanoff, 116 New Montgomery, San Francisco, representing People
for Open Space, Greenbelt Congress, urged the Board to deny this
subdivision applicant and commented no action should be taken until the
Williamson Act has expired on this land.
Sanford Skaggs spoke in rebuttal.
The public hearing was closed.
Supervisor Schroder commented on the issues that had been raised and
moved to direct staff to take his remarks into consideration on not
setting a precedent relative to the Williamson Act if this property is
divided into five lots, what vehicle can be developed for absolute County
control over the placement of the homes and what vehicle could be
developed to preclude further subdivision of the 20 acre sites, to come
back to the Board within two weeks with various alternatives for action
that the Board could take based on his concerns and those others might
have.
Supervisor Torlakson spoke in support of the motion, commenting that
he could not support the current application in 'its present form in any
way because of what he felt to be a precedent setting nature of the
application and that he would examine any proposal returning to the Board
.and would vote on that proposal when it was before the .Board reserving the
right to analyze that proposal when it comes back.
Therefore, IT IS BY THE BOARD ORDERED that the public hearing is
CLOSED and Community Development Department is DIRECTED to report to the
Board on July 26, 1988 on various alternatives for action by the Board
based on concerns including setting a precedent relative to the Williamson
Act, the placement of building sites and the preclusion of further
subdivision of the building sites.
