RECOMMENDATION
AUTHORIZE the Director, Justice System Programs to approve a change order
with Oliver de Silva, the construction contractor, compensating them for
utility companies ' caused delays to their work.
FINANCIAL IMPACT
The negotiated change is $48 ,000 . Contingency project funds are available
for this change.
REASONS FOR RECOMTENDATION/BACKGROUND
The construct contract stipulated that the contractor coordinate with
Pacific Gas and Electric Company (PG&E) and East Bay Municipal Utility
District (EBMUD) and allow them an opportunity to install underground water
and gas mains. After conversations with both utility companies, Oliver de
Silva (ODS) scheduled three weeks for this work to be done. This work was
on the project schedule' s "critical path" because these utilities were to
be installed under the relocated Giant Highway. The contractor had to
first complete the required cut and fill and subgrade work before the
utilities could be installed. The contractor could not proceed with
completing the street construction activities (gravel base and asphalt)
until the utility company work was complete. The majority of the site
rough grading could not begin until the street relocation work was
completed, since the existing Giant Highway alignment went through the
middle of the project site. The existing street could not be closed until
the new street was open.
The contractor originally turned the graded roadway over to the utility
companies on November 30 ; however, winter rains in December and January
stalled all construction activities until January 19. Given the
contractor' s original schedule, . revised to reflect the rain delays, the
utility companies should have completed their work on or before February
10. Both utility companies took longer than originally scheduled. PG&E
finished their work on March 2 and EBMUD completed their w k on March 10 ,

30 calendar days beyond the contractor ' s revised schedule. Based on
language in the contract and referenced CALTRANS specifications, ODS
submitted a "right-of-way" delay claim asking for a time extension and
additional compensation in the amount of $115,730. After a number of
negotiation sessions, the County' s Project Manager and the contractor
agreed that a 30 calendar day time extension, of which 12 days were
compensable, was a fair and reasonable settlement. Compensation was
established at $4 ,000 per day based on the number of idle pieces of grading
equipment at the site. The settlement, therefore, was 12 times $4 ,000
equalling $48 , 000.
