The Contra Costa County Board of Supervisors RESOLVES THAT:
1 . On June 14, 1988, the Employee Relations Officer submitted a Letter
of Agreement with Contra Costa County Employees Association, Local No. 1 , dated
June 6, 1988, providing for the utilization of a Lead Painter in the Sheriff's
Facilities.
2. This Board having thoroughly considered said Letter of Agreement,
the same is approved.
3. Terms and Conditions for Utilization of a Lead Painter. .The Letter
of Agreement with Contra Costa County Employees Association is attached hereto,
marked Exhibit A, and Sections Numbers 1. through 13 inclusive are incorporated
herein as if set forth in full .
4. If an Ordinance(s) is required to implement any of the foregoing
provisions., the Board of Supervisors shall enact said Ordinance(s) .

Re: Agreement on Lead Painter for Supervising
Inmates to Paint in the Sheriff's Facilities
Dear Ms. Kinney:
The following represents the agreement reached on the Lead Painter proposal to
provide pay for work in a higher classification as a Lead Painter giving direc-
tion to inmates performing painting activitiesin the Detention Facilities.
1 . Lead Painter duties will be made on a similar arrangement to other crafts
working in the Detention Facilities with a minimum six-month assignment,
the method for making assignments to be discussed among the Painters.
2. The number of inmate workers, who will be Trustees screened to eliminate
violent and serious offenders, will be determined by the Lead painter, based
on work to be performed; the crew size will be no more than 10 for cleanup
preparation work and approximately four or five for painting.
3. The Lead Painter will be given training by the Sheriff's Department prior to
undertaking any work with inmates, similar to that given other employees
working in the Detention Facilities.
4. Control of tools, materials, and equipment will be handled similarly to
other crafts working in the facilities, with supplies issued and accounted
for at the end of each work shift.
5. The Lead Painter will be allowed lunch and breaks away from the inmates.
6. The Lead Painter will not be expected to handle any disciplinary problems
with inmates and will have a scan pen to use if a Deputy is needed.
7. The Lead Painter will work under the direction of the Facilities Trade
Supervisor in charge of painting and will work with the Supervi sor to deter-
mine supplies and equipment needed to perform painting assignments in coor-
dination with a facilities representative of the Sheriff's Department.
8. Painting activities i n"the.Martinez Detention Factl i ti es (MDF) will be per-
formed only in..,areas.1away from :the .view.of the. public.
9, Painters assigned to provide lead direction to inmantes will receive pay
for work in a higher classification beginning on the first day of the
assignment and will also receive hazard pay when working in the MDF and the
Clayton Rehabilitation Center commencing on July 1 , 1988.
10. Inmates assigned to the painting program will wear a plastic type vest or
similar distinctive wear so that the Lead Painter can easily observe the
crew members. .
11 . The Lead Painter will have the choice of driving either a personal vehicle
or a County vehicle from the shop to the facility.
12. The Lead Painter assigned to the Sheriff's painting program in one of the
detention facilities will work a 4/10 shift.
13. This program will remain in effect for one year from the date of adoption
at which time it must be reviewed by Local 1 , Sheriff's personnel , General
Services and County Per unless a serious concern warrants earlier
review and termination.

As the attached memorandum indicates, the Detention Divi.sion. and the General .
Services Department have met and- discussed the,,ag:reement which will implement
the GSD/inmate painting program within the detentionfacilities.
We have general agreement -with the program as outlined by GSD and are
ready to begin the program on an experimental basis. We anticipate that
there will be some'coordi nation. probl ems as we move into this new endeavor.
However, each department is committed to make the program successful and
cost effective for the county.
Please place the item on, the Board of Superv;i,sors agenda at- the earliest
opportunity. We appreciate your commitment and support on this issue.
