May 26, 1988 CC ^ SUBJECT: Legislation: Senate Bill 2612 (Mello) SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AIS JUSTIFICATION RECOMMENDATION: Adopt a position in support of SB 2612 by Senator Mello which would create an abandoned vehicle abatement program. BACKGROUND: The Board is already on record in support of SB 144 by Senator McCorquodale which passed the Senate in 1987 and is currently on third reading on the Assembly floor. Senator Mello has now introduced SB 2612 which is nearly identical to SB 144. SB 2612 includes the following features: It imposes a $1 :00 registration fee on each vehicle except those exempt from registration for three years from July 1, 1989 to June 30, 1992. The fees are collected by the State and deposited in the Abandoned Vehicle Trust Fund. These fees are used to reimburse the CHP and DMV for their costs under the bill, to reimburse city police and county sheriffs for the abandoned vehicle survey required by the bill and to reimburse cities and counties which choose to conduct an abandoned vehicle abatement program. The California Highway Patrol, city police, and county sheriffs are required to conduct a survey to determine how many abandoned vehicles there are in California. The CHP is required to report the results of this survey to the Legislature and thereafter to annually report to the Legislature on the effect of the abandoned vehicle abatement program. SB 2612 also authorizes cities and counties to establish procedures for the abatement and removal of abandoned vehicles from public or private property as a nuisance. The bill authorizes cities and counties to recover their costs by placing a lien on the owners ' property. The bill also authorizes the California Highway Patrol to administer a local abandoned vehicle abatement program at the request of the city or county. Tom Ross, CHP SUPERVISORS AND COUNTY ADMINISTRATOR Senator Henry Mello Ralph Heim, Jackson/Garish BY ,DEPUTY M382/7-83 - AL) , Page 2 If the city or county establishes an abandoned vehicle abatement program, it can receive money from the $1 .00 registration fee based on the proportion of registered vehicles in the city or county compared to the total number of registered vehicles in all jurisdictions which submit an allocation plan to the Controller by May 1, 1989 . The Controller is then required to make transfers of the registration fee money to cities and counties monthly, beginning August 1, 1989 . The allocation plan which is required by the bill provides for how the funds being received from the State will be allocated among the cities and county which have chosen to operate an abandoned vehicle abatement program. A city wishing to operate a program must consult with each of the other cities and the county. The allocation plan must be adopted by the county and by a majority of the cities containing a majority of the population in the incorporated area of the county. The bill also requires that SB 144 be passed and implemented in order for SB 2612 to be operative. SB 2612 passed the Senate Transportation Committee April 7, 1988 by a vote of 10: 0. It passed the Senate Appropriations Committee May 12 , 1988 by a vote of 7: 0, and passed the full Senate on May 20 by a vote of 29: 0 . The bill is now awaiting assignment to the Assembly Transportation Committee.
