SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND Alm JUSTIFICATION
RECOMMENDATION:
Adopt a position in support of SB 2135 by Senator Presley
relating to the Trial Court Funding Act. ,
BACKGROUND:
There . has been considerable confusion regarding which fines and
forfeitures would have to be surrendered to the State if a county
opts in to SB 709, the Trial Court Funding Act. There has also
been an effort by a number of groups, to have specific fines and
forfeitures excluded from being returned to the State.
Senator Presley has introduced SB 2135 which allows counties to
keep law library fees, criminal justice facility fees, courthouse
construction fees, money collected relating to fish and game
violations, thepenaltyassessment to , fund the CAL-ID program,
the criminal laboratory analysis fees, assessments specified in
Section 1464 of the Penal Code, diversion fees specified in
Sections 1001. 15 and 1001. 16 of the Penal Code, the automated
county warrant system fees, drug program and alcohol abuse
education and prevention fees, and fees collected for the service
of process. In addition, SB 2135 allows counties to retain 500
of the growth in fees, fines and forfeitures, to the extent that
that growth exceeds the percentage increase in the county' s block
grant. In other words, if the block grant any given year goes up
4% and the county' s collection of fines and forfeitures goes up
100, the county would be entitled to keep 30 of the total fines
and forfeitures collected ( 1/2 of the difference between loo and -
40) .
The Municipal Court Administrator recommends that the Board of
Supervisors support SB 2135 since it allows the county to retain
fines and forfeitures for several specific programs and because
it allows the county an incentive to collect additional fines and
forfeitures. This office concurs with that recommendation.
