SPECIFIC REQUEST(S) OR RECOMMENDATIONS) & BACKGROUND AND JUSTIFICATION
RECOMMENDATION:
Adopt a position in opposition to SB 2075 by Senator Green unless
the bill is amended to appropriate sufficient funds to cover the
cost of the increase in jury fees.
BACKGROUND:
Current law authorizes a minimum jury fee of $5. 00 per day unless
a higher fee of up to $10. 00 per day is authorized by county
ordinance. In addition, under current law, if a juror is
required to remit the compensation to his or her employer, no fee
higher than $5. 00 per day is permitted.
SB 2075 would increase the minimum mandatory jury fee from $5 .00
per day to $15 .001 per day and would authorize the county to
increase that fee up to $25. 00 per day. In addition, SB 2075
would eliminate the provision limiting the jury fee to $5. 00 per
day where the juror is required to remit the fee to his or her
employer.
If Contra Costa County eventually opts in to SB 709, it appears
likely that this would be one of the court-related mandates the
County would be required to waive as a condition of receiving the
trial court block grant. As a result, the entire cost of jury
fees could become 100% County-funded. This would have the effect
of more than tripling jury expenses and making all of the
increase a county rather than a State cost.
The Municipal Court Administrator has recommended that the Board
seek amendments to SB 2075 in order to insure State funding for
the increased cost. This office concurs and is, therefore,
recommending that the Board oppose SB 2075 unless it is amended
to provide full funding for the increased costs.
SB 2075 passed the Senate Judiciary Committee by a vote of 8 : 0 on
April 14, 1988 and is scheduled for a hearing in the Senate
Appropriations Committee on May 23 , 1988.
