TO- BOARD OF SUPERVISORS FROM: Phil Batchelor C ltra County Administrator Costa DATE: May 24, 1988 SUBJECT: Legislation: Senate Bill 1859 (Presley) SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION• Adopt a position in support of SB 1859 which clarifies current law to provide that a peace officer may take a child into temporary custody if the officer is convinced that the child is in immediate danger of physical or sexual abuse. BACKGROUND: Current law allows a peace officer to take a minor into temporary custody when the child is in immediate danger of continued physical or sexual abuse. Proving immediate danger of continued abuse may prove difficult and, apparently, was not the original intent of the Legislature. SB 1859 removes the word "continued" thereby requiring only that the peace officer be convinced that a child is in immediate danger of physical or sexual abuse. The Social Services Director recommends that the Board support SB 1859 and this office concurs in that recommendation. SB 1859 passed the Senate Judiciary Committee March 8, 1988 by a vote of 8 : 0 and passed the Senate March 17 , 1988 by a vote of 36: 0. The bill is currently pending a hearing in the Assembly Judiciary Committee.
