SUBJECT: Solid Waste Management Plan Extension
The Board received the attached letter dated June 17,
19.88 from Sherman E. Roodzant, Chairman, California Waste
Management Board, 1020 Ninth Street, Suite 300, Sacramento 95814,
denying request by Contra Costa County for an extension on the
County Solid Waste Management Plan.
IT IS BY THE BOARD ORDERED that the attached letter is
REFERRED to the Community- Development Director, County Counsel,
Solid Waste Commission and all cities.

Subject: Request for a time extension for completing the County
Solid Waste Management Plan Revision
Dear Chairman Schroder:
Since your County Solid Waste Management Plan (CoSWMP) became
delinquent on May 12, 1988, the California Waste Management Board
(CWMB) , at its May 12-13, 1988 meeting, referred the matter to
the State Attorney General.
In your May 10, 1988, letter you requested that the CWMB consider
granting Contra Costa County a one (1) year time extension for
preparing the County Solid Waste Management Plan (CoSWMP)
Revision. You stated in the letter that the current Board of
Supervisors ' deadlock on the selection of a future landfill had
prevented the County from approving, within 120 days, a CoSWMP
with future sites as required by Government Code section 66780. 2.
Neither the Government Code nor the existing planning regulations
allow the CWMB to grant time extensions for CoSWMP Revisions.
California Code of Regulations, Title 14, section 17152, requires
that the CoSWMP Revision be prepared within 270 days after this
Board accepts the Plan Review Report. Since neither the
Government Code nor our regulations allow time extensions for
CoSWMP Revisions, the CWMB is unable to grant your request, and
the CoSWMP is considered delinquent.
Referral of delinquent CoSWMPs to the Office of the Attorney
General follows policy of the California Waste Management Board
established at its February 7-8, 1985 meeting. The policy
states:
1. No time extensions: Neither solid waste law nor
regulations provide for the granting of extensions beyond
the 270 days permitted for counties to submit CoSWMP
revisions to the Board.

2. Referral of delinquent CoSWMP cases to the State Attorney
General : State law specifically provides the CWMB with the
remedy of asking the Attorney General to enforce solid waste
planning law provisions.
In addition to the establishment of this policy, the CWMB
determined it would neither find a project in conformance with
the CoSWMP nor concur in the issuance of a Solid Waste Facilities
Permit for a project unless a current CoSWMP exists.
