McAdams (Owner) - 2718-RZ, Requests to rezone 12.2 acres from Single Family Residential District (R-20) to Planned Unit Dis- trict (P-1) , Development Plan #3020-87 & Subdivision #6934, in the Walnut Creek area. (S.D. III ) SPECIFIC REQUEST(S) OR RECOMMENDATIONS(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS 1. Approve rezoning application 2718-RZ, James R. Stedman & Associates (Applicant) , Robert E. McAdams (Owner) , as approved by the County Planning Commission on May 10, 1988. 2. Approve Development Plan #3020-87 for a 23 unit single family residential project; Approve the tentative map for Subdivision #6934 , requesting approval to divide the 12.2 acres into 23 residential lots. 3. Adopt the Planning Commission' s findings as set for in its resolution #30-1988, as the basis for your Board' s decision. 4. Accept the environmental review documentation as being adequate. 5. APPROVED AS RECEDED x OTHER x The Board of Supervisors on June 21, 1988, closed the public hearing on the above matter and declared its intent to approve the project request pending resolution of the drainage course and deferred the decision to the June 28, 1988 Determination Calendar. Supervisor Schroder commented that Flood Control had been in contact with the neighborhood and all parties were willing to work together. Supervisor Schroder moved to approve the recommendation as presented and requested Flood Control and the neighborhood to work together to resolve the drainage issue and that the responsibility on the neighborhood would be to provide the easements for Flood Control. Therefore, IT IS BY THE BOARD ORDERED that recommendations 1, 2 (with conditions attached Exhibit A) , 3, 4, and 5 are APPROVED and as in recommendation 5 , Ordinance No. 88-52 is INTRODUCED, reading waived, and July 12, 1988 is set for adoption of same; and Flood Control staff is REQUESTED to work with residents of the neighborhood to resolve the drainage issue with the responsibility of the neighborhood being to provide the easements for Flood Control. This approval is for a maximum of 23 residential dwelling units as general- ly shown on the revised final development plan dated received by the Commu- nity Development Department on May 5, 1988. Said exhibit also provides for preliminary grading plan and vesting tentative map. 2. A fencing program for the perimeter of the project shall be submitted for the review and approval of the Zoning Administrator. Approved fencing shall be installed no later than residential construction on respective lots. 3. A street name and street numbers shall be subject to the review and approv- al of the Community Development Department, Graphics Section. The proposed name and addresses shall be submitted at least 30 days prior to filing a final map. 4. Final grading plans shall be subject to Zoning Administrator review and approval . Grading shall maintain a balance of cut and fill and avoid any import or export of material . 5. A project identification design feature(s) may be established at the en- trance to the project subject to the Zoning Administrator review and ap- proval . 6. An archaeological field reconnaissance report shall be prepared and submit- ted to the Community Development Department. This report, shall be prepared by a professional archaeologist who is certified by the Society for Cali- fornia Archaeology (SCA) and/or the Society of Professional Archaeology (SOPA) . The applicant shall implement mitigation measures identified in the study. 7. All residences will provide for a lighted street address which is plainly visible from the street. 8. The following noise and dust mitigation measures shall be implemented. A. Noise generating construction activities shall be limited to the hours of 7:00 A.M. to 5:00 P.M. , Monday through Friday. B. The project sponsor shall require their contractors and subcontractors to fit all internal combustion engines with mufflers which are in good condition and to locate stationary noise-generating equipment such as air compressors and concrete pumpers as far away from existing resi- dences as possible. C. The applicant shall post on the site and mail to adjacent property owners and to the County a list of contact persons with name, title, phone number and area of responsibility. The person responsible for maintaining the list shall be included. The list shall be kept cur- rent at all times and shall consist of persons with authority to ini- tiate corrective action in their area of responsibility. ENEMY Y A h 2 ¢Y D. Dust shall be kept down by watering which shall be accomplished by a watering truck kept on site or from hydrants on site. The name of the responsible person shall appear on the list of contact persons. 9. Unless otherwise stipulated below, the guide for development of residential units shall be in accord with the R-15 Zoning District: Frontyard Setback - 25 feet minimum. Rearyard Setback - 15 feet minimum. Sideyard Setback - 15 feet minimum to property line and 5 feet to edge of slope whichever is nearer. All dimensional requirements are subject to further Zoning Administrator review and approval at the time of issuance of building permits. 10. For the three heritage oak trees to be preserved, the applicant shall sub- mit a tree preservation and protection program for the review and approval of the Zoning Administrator. The program shall address the construction and post-construction stages of the project. 11. Comply with drainage, road improvement, traffic and utility requirements as follows: A. In accordance with Section 92-2.006 of the County Ordinance Code, this subdivision shall conform to the provisions of the County Subdivision Ordinance (Title 9) . Conformance with the ordinance includes the fol- lowing requirements: B. The following exception to Title 9 is permitted for this subdivision: 1) Chapter 96-8, "Sidewalks and Paths" . C. Align the storm drain, beginning from the drainage inlet between Lots 1 and Lot 2 at the easterly property line of the subdivision, norther- ly along the easterly property line of Lot 1 and thence westerly along Blackwood Drive to the access road. D. Provide a minimum of 300 feet of sight distance to the east along Blackwood Drive from the point that the access road intersects with Blackwood Drive. E. Provide for adequate sight distance along the Blackwood Drive curve opposite Hadden Road, based on a 30 m.p.h. speed limit. F. The interior subdivision street shall be dedicated to the County and constructed to County public road standards. G. The storm drain easements shown encompassing the concrete lined inter- ceptor ditches on the Tentative Map are not to be dedicated to Contra Costa County or the Flood control District. H. Furnish proof to the Public Works Department, Engineering Services Division, of the acquisition of all necessary rights of entry, permits D II R 3 F and/or easements for the construction of off-site, temporary or perma- nent, road and drainage improvements. I . Comply with the drainage fee requirements for the Sans Crainte Drain- age Area as adopted by the Board of Supervisors. J. Comply with the requirements of the Bridge/Thoroughfare Fee Ordinance for the Countywide Area of Benefit as adopted by the Board of Supervi- sors. K. Prior to issuance of building permits, file the Final Map for Subdivi- sion 6934. THE FOLLOWING STATEMENTS ARE NOT CONDITIONS OF APPROVAL OF THE SUBJECT APPLICA- TIONS BUT ARE IDENTIFIED TO ADVISE THE APPLICANT OF THE DEVELOPMENT REQUIREMENTS OF OTHER AGENCIES. A. Comply with the requirements of the Contra Costa County Consolidated Fire Protection District. B. Comply with the requirements of Central Sanitary District. C. Comply with the requirements of East Bay Municipal Utility District. D. Comply with the requirements of the Building Inspection Department. E. This project may be subject to the requirements of the Department of Fish and Game and the U.S. Army Corps of Engineers. The applicant should notify the Department of Fish and Game, P.O. Box 47, Yountville, CA 94599, of any proposed construction that may affect the San Ramon Creek Bypass, per Sec- tions 1601 and 1602 of the Fish and Game Code. Also, the applicant should notify the U.S. Army Corps of Engineers, 211 Main Street, San Francisco, CA 94105-1905, Attention: SPNCO-R, of any proposed construction with the creek in accordance with Section 404 of the Clean Water Act (33 U.S.C. 1344) .
