Penal Code section 853. 7a and Vehicle Code section 40508. 5 are hereby implemented as of the effective date of this Resolution in Contra Costa County. 2. The courts of Contra Costa County are authorized to impose an assessment of seven dollars ( $7 ) upon every person convicted under Penal Code section 853. 7 , whether or not a fine is imposed. 3. The courts of Contra Costa County are authorized to impose an assessment of seven dollars ( $7 ) upon every person convicted under Vehicle Code section 40508, whether or not a fine is imposed. 4 . Adopt resolution, effective July 1, 1988, implementing Penal Code Section 853.71 and Vehicle Code Section 40508.5 in Contra Costa County, and authorizing the courts of Contra Costa County to impose an assessment of $7 for a County Automated Warrant System. 2. Direct the County's Justice Automation Advisory Committee to develop a plan for the County Automated Warrant System, including an implementation schedule and a financial plan providing for joint city/County financial support of such a system. 3. Authorize the County Auditor-Controller to establish a special revenue account into which all assessments are deposited. FINANCIAL IMPACT: According to the County Municipal Court Administrator, the $7 assessment will raise approximately $130,000 annually. The total cost of the County automated warrant system is unknown at this time pending development of a plan by the Justice Automation Advisory Committee. It is anticipated that the $7 County fee will also require additional funds from the cities in order to operate a Countywide coordinated system. BACKGROUND/REASONS FOR RECOMMENDATIONS: Chapter 151, Statutes of 1986, authorizes a county's board of supervisors to authorize, by resolution, the courts of the county to impose, in addition to any other fees authorized by law, an assessment of $7 on any person convicted of a violation of a promise to appear for a driving offense or any other matter or for failure to pay a fine lawfully imposed by a court for a violation of the Vehicle Code, as specified. Currently, development of a Countywide automated warrant system is part of the Justice System Automation Plan. It has the strong support of the Sheriff's Department and county police agencies. Implementation of the $7 fee would generate at least part of the funds needed to implement and operate such a program. The Justice Automation Advisory Committee is composed of the necessary County and City representatives, including Sheriff-Coroner, County Auditor-Controller, municipal courts, and representatives of various police agencies. This planning and development mechanism also guarantees that the warrant system will be integrated with the other law and justice automated systems. It should be noted that currently this fee is one of the fees subject to revenue recapture if this County opts into Trial Court Funding. There is, at present, legislation pending to revise the Trial Court funding legislation to exempt this fee from such recapture. Based upon a recommendation of the County Municipal Court Administrator that this exemption will probably occur, it is recommended that your Board proceed to authorize this program, effective July 1, 1988. In the event, however, that this County opts into Trial Court Funding and the fee is not exempted and reverts to the State, we may request your Board to negate the above action.
