HomeMy WebLinkAboutMINUTES - 06271988 - 1.37 0/1 To: BOARD OF SUPERVISORS JL-037 FROM: Phil Batchelor C=tra County Administrator CWIa DATE: June 21, 1988 C"^ SUBJECT: Legislation: Assembly Bill 3063 (Polanco) SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATION• Adopt a position in support of AB 3063 which directs the Department of Motor Vehicles to develop a pilot program to test the cost-effectiveness of collecting parking citations on a vehicle which has been sold. BACKGROUND: Under current law, no mechanism exists to collect parking tickets on vehicles which have been sold. Under current law, the municipal court notifies DMV of excessive numbers of unpaid parking tickets which DMV ' then attaches to the vehicle' s registration so that they must be paid in order to get the vehicle re-registered. However, if the vehicle has been sold with outstanding parking tickets on it, there is no mechanism to force the new owner to pay those tickets nor does it seem fair or equitable to do so. In addition, there has not been a . cost-effective method of collecting on those parking tickets from the previous owner. Roy Chiesa, Municipal Court Administrator, has brought to our attention AB 3063 which has been introduced by Assemblyman Polanco. This bill directs the DMV to develop a pilot program in an effort to design a cost-effective mechanism for collecting these outstanding parking citations on a vehicle which has been sold. Mr. Chiesa notes that on many occasions members of the same family will transfer vehicles among themselves in order to avoid paying parking tickets, or will otherwise find seemingly legal mechanisms to avoid paying these parking citations. While it is not clear from the language of the bill as it was amended June 9, 1988 exactly what type of program might be designed, it clearly seems worthwhile to support this legislation and to cooperate in whatever way is possible with the DMV in attempting to design such a pilot program. Mr. Chiesa reports that the County dismisses thousands of dollars in parking citations each year which have been returned by the DMV because the individual who was cited no longer owns the vehicle in question. Mr. Chiesa recommends that the Board support AB 3063 and this office concurs in that recommendation.
