SUBJECT: Recycling Legislation
SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION
RECOMMENDATIONS:
1. Support SB 2113 (Montoya and Kopp) which establishes a 200
goal for recycling programs and requires the preparation and
submission of county and city recycling plans.
2. Support AB 3298 (Killea and Cortese) if amended to vest
jurisdiction in the California Waste Management Board rather
than the Department of Conservation, delete the exclusion of
waste-to-energy fuels in calculating the reduction in the
waste stream, delete the need to establish guidelines for
50% diversion of, the waste stream, and delete the penalty
assessment for late plans or failure to achieve goals.
3 . Emphasize that the Board of Supervisors supports minimum
goals which are at least as high as the County' s current
goal, and that the Board' s support for SB 2113 in no way is.
intended to imply that the County's goals should be lowered
to the 20% goal established in the bill.
4. Request the County Administrator to ask the authors of both
SB 2113 and AB 3298 to amend their bills to permit the use
of fees raised in the recycling plan to be used for solid
waste public education programs as well as other elements of
the preparation and implementation of the recycling plan.
BACKGROUND:
Our Committee asked staff from the Community Development
Department to review pending legislation dealing with solid waste
recycling and to recommend positions on pending legislation.
SB 2113 does the following:
o Establishes legislative findings regarding the value of
recycling in reducing the amount of solid waste which
must be disposed of in landfills.
o Makes the California Waste Management Board responsible
for implementation of the bill.

o Requires development of county and city recycling plans
which must be integrated into the county solid waste
management plan. The cities which choose to prepare
their own recycling plans must adopt such plans by
January 1, 1990 . The county must then prepare and
adopt a plan by January 1, 1991 to include all areas of
the county except those cities which chose to adopt
their own plans.
o The recycling plan must include the following:
designation of a county recycling coordinator;
a study of the composition of the total solid
waste stream.
The .goal is to recycle 200 of the total waste stream.
The composition study must be completed by January 1,
1993 .
o The plan must also designate those materials that are
to be recycled and the programs which will be used to
achieve the 20% goal.
o The plan must also include a detailed budget for the
recycling programs and a description of the fees to be
charged to cover the cost of the program.
AB 3298 is similar to SB 2113 except in the following respects:
1. Responsibility is placed in the Department of
Conservation rather than the California Waste
Management Board.
2. The recycling goal is a 25% reduction within three
years.
3 . The bill specifically excludes waste-to-energy fuel as
a part of the methods to achieve the 25% goal.
4. The recycling plan is to be submitted when the first
revision is made to the solid waste management plan
after January 1, 1990, but in no case later than
December 31, 1992.
5. The bill requires the Department of Conservation to
determine guidelines by July 1, 1989 on how a 25%
diversion of the waste stream can be achieved, and by
January 1, 1991 on how the 50% diversion of the waste
stream can be achieved.
Staff point out that it will be very confusing to deal with the
Department of Conservation on the recycling portion of the solid
waste management plan when the California Waste Management Board
is responsible for all other elements of the solid waste
management plan. Staff also believes that a 50% diversion of the
waste stream is unrealistic. Staff also points out that
waste-to-energy should be considered a viable method of reducing
the waste stream and, therefore, should not be excluded as one
way to achieve a 25% goal.
Our Committee believes that the County' s current goals should
serve as the minimum for this County. We believe that a 25%
diversion of the waste stream is realistic and, therefore,

although we are recommending support for SB 2113 , we wish to make
it clear that we do not endorse any goal lower than that
presently established for this County.
SB 2113 passed the Senate Local Government Committee June 15 by a
vote of 6: 0 and is currently pending in the Senate Appropriations
Committee. AB 3298 passed the Assembly Natural Resources
Committee by a vote of 8 : 4 on April 14, and the Assembly Ways and
Means Committee by a vote of 14: 8 on June 9. AB 3298 is
currently pending on the second reading file on the Assembly
floor.
