June 13 , 1988 C J* SUBJECT: Solid Waste Resource Recovery Program SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & BACKGROUND AND JUSTIFICATION RECOMMENDATIONS: 1 . Request Supervisors Torlakson and Fanden to meet with a subcommittee of the Contra Costa Mayors ' Conference to make a presentation on the options available for implementing a countywide resource recovery program as follows: A. Delay the program until funds are received from Acme Fill complying with a condition on the land use permit for the transfer station. B. Sue Acme for failure to comply with the conditions of the land use permit for the transfer station. C. Identify some alternative sources of funding. D. Convince the cities to commit their waste stream to the transfer station so Acme will be able to move ahead with its construction. Include as a part of the presentation the indication from Delta Diablo Sanitation District that they are willing to assist in funding a solid waste public education program, but only if other public entities participate in the program. 2 . Request the Director of Community Development to schedule time on the next agenda of the Solid Waste Commission to make a similar presentation to that outlined above. 3 . Authorize Supervisors Fanden and Torlakson to represent the Board of Supervisors in these presentations before the subcommittee of the Mayors ' Conference and the Solid Waste Commission. 4. Request County Counsel to report to the Board on possible grounds for a lawsuit against Acme Fill if other alternatives for funding the resource recovery program do not develop. CLERK OF THE BOARD OF SUPERVISORS AND COUNTY ADMINISTRATOR BY I;al.A(� Z„�rk M38217-83 /bZif.�w.� DEPUTY Page 2 BACKGROUND: As we have reported to the Board previously, the Community Development Department is having trouble convincing Acme Fill that they owe the County $100,000 as a condition of the approval of the land use permit for the temporary and permanent transfer stations. It was our understanding that approval of the land use permit was sufficient to transfer the $100,000 payment regardless of whether the transfer station is ever built. Acme Fill is interpreting the conditions somewhat differently, and have indicated they do not wish to pay the $100, 000 until they are sure the transfer station will be built. The principal delay in assuring construction of the permanent transfer station is that the franchising entities in the County must be willing to commit their waste stream to the transfer station in order to assure potential funding agencies that the transfer station is economically viable. Our Committee has outlined the alternatives listed above and are recommending that these alternatives be described to the subcommittee of the Mayors ' Conference and the Solid Waste Commission in an effort to resolve existing delays and insure adequate funding for the .resource recovery program. Creation of the resource recovery specialist position was approved on the Consent calendar by the Board of Supervisors this morning (June 21, 1988) . However, the position cannot be filled until we have an assured method of funding the program.
