NOES: None. ABSENT: None. ABSTAIN: None. SUBJECT: Determination of Property Tax Transfer) for Annexation No. 270 and 271 to West) Contra Costa Sanitary District (LAFC ) RESOLUTION 88/ 335 88-19 and 88-22 respectively) ) WHEREAS, Section 99 . 1 of the Revenue and Taxation Code provides that a jurisdictional change resulting from a special district providing one or more services to an area where such services have not been previously provided shall not become effective if one or more affected special districts involved in the property tax exchange negotiation fails to adopt a resolution agreeing to a transfer; and WHEREAS, with the exception of the annexing district, the Board of Supervisors shall determine the property tax exchange for each affected district that fails to adopt a resolution agreeing to a property tax transfer; and WHEREAS, Annexation No. 270 and - 271 to West Contra Costa Sanitary District (WCCSD) propose annexation of territory which results in the provision of services not previously provided and no resolutions have been adopted agreeing to property tax exchanges; and WHEREAS, in the absence of a master agreement for property tax exchange between the County and WCCSD, the County and WCCSD have agreed that the property tax exchange agreement for this annexation will be in accordance with the terms of the existing master agreement between the County and the Central Contra Costa Sanitary District and the East Bay Municipal Utility District. THEREFORE, IT IS BY THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY RESOLVED that the property tax increment allocation factors for the affected agencies in the area of the subject annexations for the fiscal year for which the State Board of Equalization makes the tax rate area changes for this jurisdictional change shall be in accordance with the above master agreement. Said factors shall apply in subsequent years unless changed by the mutual agreement of affected agencies or subsequent jurisdictional changes. Such increment tax allocation factors apply to affected territory as submitted or revised by the Local Agency Formation Commission. This resolution does not change the affected districts ' right to collect taxes for existing bonded indebtedness. SUBJECT: Determination of Property Tax) Exchange for Ironwood Court ) Boundary Reorganization ) RESOLUTION NO. 88/ 373 (LAFC 88-12) ) WHEREAS, Section 99 of the Revenue and Taxation code provides that the City and the County shall agree by resolution to exchange property tax revenues among themselves and any affected agencies in the event of a jurisdictional change; and WHEREAS, the Ironwood Court Boundary Reorganization (LAFC 88-12 ) involves annexation of territory to the City of Pleasant Hill for which property tax exchange is determined by the previously approved master property exchange agreement; and WHEREAS, the reorganization proposes concurrent annexation to the Pleasant Hill Recreation and Park District which would result in the district providing services in an area where such services have not previously been provided and where Section 99 . 1 of the Revenue and Taxation Code provides for the annexing agency to negotiate for a portion of the growth property tax in the affected territory; and WHEREAS, for the property tax allocation to be made under this resolution, the Auditor-Controller of Contra Costa County shall first apply the provisions of the master property tax agreement between the City of Pleasant Hill and the County and then apply the tax increment allocation factors for property tax increment apportionment to the Pleasant Hill Recreation and parks District as shown on the attached schedule marked Exhibit A; THEREFORE, BE IT BY THE BOARD OF SUPERVISORS OF CONTRA COSTA COUNTY RESOLVED that the property tax increment allocation factors for the affected agencies in the area of the Ironwood Court Boundary Reorganization (LAFC 88-12 ) shall be as shown on the attached schedule (Exhibit A) for the fiscal year for which the State Board of Equalization makes the tax rate area changes for this jurisdictional change.
