RESOLUTION NO. 88/371 SUBJECT: RESOLUTION OF THE BOARD OF SUPERVISORS OF THE COUNTY OF CONTRA COSTA ORDERING THE ESTABLISHMENT OF AN EMERGENCY MEDICAL SERVICES FUND WHEREAS pursuant to Chapter 2.5, Part 1, Division 2.5 of the California Health and Safety Code (commencing with Section 1797.98a) , as added by Chapter 1240 (Statutes of 1987) , a county, upon adoption of a resolution by its board of supervisors, may establish after January 1 , 1988, an emergency medical services fund; and WHEREAS, the money in a county's emergency medical services fund must be used to pay for certain unreimbursed emergency medical service costs with the county. NOW, THEREFORE, BE IT RESOLVED as follows : 1. Effective July 1, 1988, an Emergency Medical Services Fund of the County of Contra Costa is established. 2. Pursuant to Penal Code Section 1465, on July 1, 1988, and thereafter, there shall be levied, and the courts shall collect, in addition to the assessments or surcharges prescribed by Penal Code Section 1464, an assessment in the amount of one dollar ($1) on fines, penalties, or forfeitures imposed and collected by the courts of Contra Costa County for criminal offenses . 3. All such assessments shall be transferred to the County Auditor-Controller for deposit to the Health Services Department' s Emergency Medical Services Fund. Payments from the Emergency Medical Services Fund shall comply with the disbur- sement requirements of California Health and Safety Code Sections 1797.98a, et seq., and shall further satisfy all disbursement conditions which may hereafter be imposed by the'- Board of Supervisors . thereby certify that this 19.4 true and correct copy of An action taken and entered on the minutes of the Board of Supervisors a shown. FINANCIAL IMPACT The Emergency Medical Services Fund allowable under Chapter 1240,1987 Statutes, SB 12 permits an assessment of one dollar ($1) to be imposed on certain fines, penalties, and forfeitures in addition to the assessments prescribed by Penal Code Section 1464. It is estimated that this assessment will yield $563,000 annually for the Emergency Medical Services Fund, 10% of which can be used to administer the program. This - fund is intended to provide reimbursement to private physicians for uncompen- sated emergency care (2/3 of the Fund) and the County' s emergency medical care needs (1/3 of the Fund). BACKGROUND/REASON FOR RECOMMENDATION Senate Bill 12 enacted by the 1987 Legislature provides a county board of supervisors the option to add $1 for certain fines, penalties, and forfeitures imposed and collected by the courts. To preclude a conflict with the Courts Funding Legislation SB 709 (1987), Senator Maddy has sponsored SB 1328 which would specify that all funds collected by a county for an SB 12 Emergency Medical Services Fund would remain with the county if and when the State assumes financial responsibility for the courts. SB 1328 further clarifies the Legislative intent of imposing $1 per $10 of the imposed fine. SB 12 provides for reimbursement of losses to physicians who provide emergency care to patients who do not make any payment for services and for whom no responsible third party payor makes any payment. Reimbursement is limited to 40% of those losses. Although these monies will help alleviate the problem of uncompensated care, it is anticipated that the claims for reimbursement will far exceed the funds. Physicians employed by county hospitals or district hospitals are precluded from reimbursement from the Emergency Medical Services Fund.
