SPECIFIC REQUEST(S) OR RECOMMENDATION(S) & ,BACKGROUND AND JUSTIFICATION
RECOMMENDATION•
Adopt a position of support for 5. 2062 by Senator Pete Wilson
which would exempt local governments from paying federal gasoline
taxes.
BACKGROUND:
Local governments have historically been exempt from the federal
gas tax at the time of purchase by certifying that the gas would
be used exclusively for local government needs. However, the Tax
Reform Act of 1986 removed local governments' exemption. Under
current regulations, the County would have to pay the federal gas
tax at the time gasoline is purchased and then file for a rebate
thereby causing an unnecessary administrative burden on local
governments.
Senator Wilson has joined Senator Don Nickles of Oklahoma and
Senator John Melcher of Montana in introducing 5. 2062 which would
exempt local governments from paying the federal gas tax and
avoid the need to go through the rebate procedure.
The Director of General Services recommends that the Board
support S.2602 and this office concurs in that recommendation.
